SR MOD REVIEW – APPROVAL CRITERIA AND FINDINGS <br />This section is presented in the same order of applicable requirements found in Section 9.8455 – <br />Modifications to Approved Site Review Plan of the Eugene Code. Applicable sections of the Code are in <br />italics, followed by proposed findings of facts in normal text. <br /> <br />9.8455 Modifications to Approved Site Review Plans. Modifications of the final approved site review <br />plan may be requested following the Type II process. The planning director shall approve the <br />request if it complies with the following criteria: <br /> <br />(1) The proposed modification is not materially inconsistent with the conditions of the original <br />approval; <br /> <br />(2) The proposed modification will result in insignificant changes in the physical appearance of <br />the development, the use of the site, and impact on the surrounding properties. <br /> <br />Finding: For (1) above, there were two Site Reviews, SR 87-15 for a building that was built on what is <br />now Lot 502 and SR 96-33 to construct a four-story, 59,000 sq ft building and associated parking and <br />amenities including the decorative trees along the main walkway into the building. The conditions in SR <br />96-33 will be the conditions to review for the modification. <br /> <br />Conditions of Approval for SR 96-33 – <br />The Planning Director’s Decision for SR 96-33, issued on May 14, 1997, approved the Site Review Plan <br />subject to three (3) conditions of approval. When considering a request to modify this Site Review, the <br />Planning Director must determine that the proposed modification is not materially inconsistent with the <br />conditions or with intent of the original approval, as required under criterion (1) above. <br /> <br />Details <br />• SR 96-33 – The original Site Review Plan case number. <br /> <br />• May 14, 1997, Decision – The date the Planning Director issued the original approval with <br />conditions. <br /> <br />• 3 conditions of approval – The specific requirements that the applicant has to meet for the use to <br />remain consistent with the land use code and findings. <br /> <br />• Modification review – When an applicant requests changes to a previously approved SR, the <br />Planning Director (or equivalent reviewing authority) must confirm that the modification does not <br />substantially alter or conflict with the original conditions or findings. <br /> <br />• "Not materially inconsistent" – This phrase means that the change cannot undermine the original <br />basis for approval or the protections the conditions were meant to ensure (e.g., neighborhood <br />compatibility, traffic, noise, etc.) <br /> <br />Original Conditions of Approval <br /> <br />1. Site Review approval of the four-story Chambers Office Building at the proposed setback is <br />contingent on the approval of the request to change the zoning of the adjacent R -2 Limited Multi- <br />family Residential to PL Public Land. <br /> <br />Finding: The applicant has previously complied with this condition of approval. As part of the original Site <br />Review approval, a condition required the rezoning of the City -owned parcel from R-2 (Low-Density <br />Residential) to PL (Public Land). The City subsequently initiated and approved Zone Change Application <br />Z 97-018 in June 1997, thereby satisfying this condition. <br />
