Criterion / Standard: <br />The MHLD must result in one dwelling unit on each middle housing lot, except <br />lots, parcels, or tracts that include a common area. Common area lots, parcels, or <br />tracts without dwelling units are permitted. <br />Response: <br />The proposed MHLD creates 2 middle housing lots, each containing or intended <br />to contain one dwelling unit. The lot configuration is shown on the tentative plan. <br />This criterion is satisfied. <br />EC 9.8194(7) - Building Code / Oregon Residential Specialty Code <br />Criterion / Standard: <br />The application must demonstrate that buildings or structures on the middle <br />housing lots created by the MHLD will comply with applicable building code <br />provisions related to new property lines and, notwithstanding the creation of <br />new lots or parcels, that structures will comply with the Oregon Residential <br />Specialty Code. <br />Response: <br />The proposed lot lines have been located to allow existing and future structures <br />to comply with applicable building code provisions related to new property lines, <br />including fire separation, openings, projections, access, and related Oregon <br />Residential Specialty Code requirements. Final compliance will be confirmed <br />through the building permit process. The tentative plan show existing building <br />footprints, eaves/projections, lot lines, and setbacks necessary to evaluate <br />compliance. In the current configuration a future dwelling may need fire <br />suppression and this can be evaluated during the building permit.
