<br />April 2024 Findings & Decision of the Planning Director Page 3 of 8 <br />E&A Rental Properties, LLC. (SR 24-1) <br /> <br />EC 9.8445(2): For a proposal for multiple-unit developments, the proposal complies with the <br />standards contained in EC 9.550 Multiple-Unit Standards. <br /> <br />The proposal does not include multiple-unit development as defined in the Eugene Zoning <br />Code. Therefore, this criterion is not applicable. <br /> <br /> EC 9.8445(3): For areas not included on the city’s acknowledged Goal 5 inventory, the <br />proposal will preserve existing natural resources by compliance with the provisions of <br />EC 9.6880 through EC 9.6885 Tree Preservation and Removal Standards. <br /> <br />The site is not included in the City’s Goal 5 inventory. There are no existing trees located on the <br />subject site. Per EC 9.6885(2)(d), this application is exempt from the Tree Preservation and <br />Removal Standard because the development site is less than 20,000 square feet and it is not <br />located above 900 feet in elevation or within the Willamette Rive Greenway. Based on the <br />findings above, EC 9.8440(3) is met. <br /> <br />EC 9.8445(4): The proposal complies with all of the following: <br />(a) EC 9.2000 through EC 9.4170 regarding applicable lot dimensions and density <br />requirements for the subject zone and any applicable overlay zones. <br />The site is located on an existing legal lot zoned S-W and there are no lot dimension standards <br />for the addition of Middle Housing. The S-W zone does not have a minimum density <br />requirement. Regarding maximum density, Per EC 9.3911(2), the maximum residential density <br />is in accordance with EC 9.2750 for the R-4 zone. Under EC 9.2751(1)(b), residential maximum <br />does not apply to triplexes. Therefore, the triplex is permitted on the subject property. Based <br />on these findings, these standards are met. <br />(b) EC 9.6800 through EC 9.6875 Standards for Streets, Alleys, and Other Public Ways. <br />No new streets, alleys or public ways are proposed or required in correlation with this proposal. <br />These standards are met. <br />(c) EC 9.6500 through 9.6505 Public Improvement Standards. <br />No Public improvements are proposed or required in correlation with this proposal. Sewer and <br />water connections will be provided to serve the new dwelling unit per EC 9.6505. These <br />standards are met. <br />(d) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard Areas – <br />Standards. <br />This site is not located in a Flood Plain, therefore these standards are not appliable.
