<br />April 2024 Findings & Decision of the Planning Director Page 2 of 8 <br />E&A Rental Properties, LLC. (SR 24-1) <br />Application Details <br />The subject site is located at 332 West 5th Avenue, on the south side of 5th Avenue, just west of <br />the intersection with Lincoln Street. It is identified as Tax Lot 3700 on Lane County Assessor’s <br />Map 17-03-31-12. The site is approximately .11 acres (4,791 square feet). The site is currently <br />developed with some surface parking, landscaping and site infrastructure that is associated <br />with the existing duplex. The subject site is zoned S-W Whiteaker Special Area Zone with /SR <br />Site Review Overlay Zone. The area surrounding the site is zoned S-W Whiteaker Special Area <br />Zone and has a range of uses including an existing office building on the property to the west <br />and north (across 5th Avenue). <br />Additional details of the proposal are included in the applicant’s written statement and <br />supporting documentation, all of which are included as part of the public record and located in <br />the application file for reference. <br /> <br />The applicant’s request is for Site Review approval under the Housing/Clear and Objective <br />criteria according to Eugene Code (EC) 9.8445. The application is subject to the requirements <br />set by the Type II land use application procedures, which are primarily addressed at EC 9.7200 <br />through EC 9.7230. <br /> <br />Procedure, Public Notice, and Agency Referrals <br />Application <br />Timeline <br />Application Submitted February 9, 2024 <br />Application Complete March 13, 2024 <br />Public Notice March 22, 2024 <br />Table 1: Relevant Application Dates <br /> <br />Public notice of this application was provided in accordance with Eugene Code requirements. In <br />response to the notice, staff did not receive any written testimony. <br /> <br />The Planning Division also provided information concerning the application to other <br />appropriate City departments, public agencies, service providers, and neighborhood services. <br />All referral comments received by the Planning Division on this application are included in the <br />application file for reference and addressed in the context of applicable approval criteria and <br />standards in the following evaluation. <br /> <br />Site Review Evaluation <br />In accordance with EC 9.8445, the Planning Director shall approve, conditionally approve, or <br />deny a Type II application, based on compliance with the listed approval criteria. Those criteria <br />are provided below (in bold), including findings addressing compliance with each. <br /> <br />EC 9.8445(1): The proposal complies with EC 9.5860 Transition Standards. <br /> <br />The Transition Standards of EC 9.5860 do not apply do not apply to the type of development <br />proposed (Middle Housing development). Therefore, this criterion is not applicable.
