may be created if more than 33% of the lot, as created, would be occupied by <br />either: <br />1. The combined area of the /WR conservation setback and any portion of the <br />Goal 5 Water Resource Site that extends landward beyond the conservation <br />setback; or <br />2. The /WQ Management Area. <br />While there are no minimum density requirements in the R-1 Zone, EC Table 9.2750 Residential <br />Zone Development Standards establishes a maximum net density of 14 dwelling units per acre <br />for the R-1 zone. As discussed in the Application Details section, the proposed partition will <br />create two parcels, with an existing duplex to remain on Parcel 1. Parcel 2 will be vacant <br />following the proposed partition. As proposed, no new parcels will exceed the maximum net <br />density of 14 units per acre if developed with single -unit dwellings. Also, in accordance with <br />state law allowances for Middle Housing, maximum density requirements do not apply to <br />middle housing development. As all proposed parcels are greater than 4,500 square feet, each <br />parcel could be developed with up to four attached or detached dwelling units (a fourplex), and <br />potentially more if developed with a cottage cluster or through an approved Planned Unit <br />Development. Based on the available information, the proposal complies with these standards and <br />this criterion is met. <br />b) EC 9.6800 through EC 9.6875 Standards for Streets, Alleys, and Other Public Ways <br />The sections listed in the above criterion establish the design, location, and dedication <br />requirements for public ways.
