connected to said 8-inch line, without conflicting with the existing service to Parcel 1, at the <br />time of future development. Based on the above findings and future permit requirements, the <br />proposed Partition complies with applicable wastewater standards. <br />EC 9.6505(3) Streets and Alleys and (4) Sidewalks <br />EC 9.6505(3) requires all streets in and adjacent to the development site to be paved to the <br />width specified in EC 9.6870 and improved according to adopted standards and specifications in <br />EC Chapter 7. EC 9.6505(4) requires that sidewalks be located, designed, and constructed <br />according to the provisions of the Land Use Code, the Design Standards and Guidelines for <br />Eugene Streets, Bikeways and Accessways, and construction and design standards adopted <br />pursuant to EC Chapter 7. <br />As discussed under EC 9.6870, Bell Avenue and Harold Street exceed the minimum paving width <br />of 21 feet, as required for low volume residential streets, but have not been constructed to city <br />standards (i.e. lacking setback sidewalks and streetlights). There are existing, fully mature street <br />trees located along the frontage of the subject property. Sidewalk construction would require <br />the removal of all six mature street trees. As such, construction of sidewalks will not be <br />required as a condition of the proposed development. However, in order to comply with the <br />standard at EC 9.6505(4), the following Conditions of Approval are warranted: <br />1. The applicant shall submit an Irrevocable Petition for public improvements in Bell <br />Avenue to include setback sidewalks and streetlights. <br />2. The applicant shall submit an Irrevocable Petition for public improvements in Harold <br />Street to include setback sidewalks and streetlights. <br />Irrevocable petitions enable the City to initiate a local improvement process and obligate the <br />property owners to pay their proportional share of the street construction costs in the future. <br />The City could construct the street when the majority of benefiting property owners agrees to <br />pay for the improvements. <br />Based on the above findings and Conditions of Approval, the proposed Partition complies with <br />these standards. <br />EC 9.6505(5) Bicycle Paths and Accessways <br />According to Public Works referral comments, no bicycle paths or public accessways are <br />proposed or otherwise required in this instance. <br />d) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard <br />PT 24-11 The Syrios Trust <br />Findings & Decision of the Planning Director I December 2024 Page 6 of 14
