Floral Hill Terrace Subdivision <br />Tentative Subdivision – Written Statement 18 <br />May 15, 2026 <br /> <br /> <br />Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 <br />Landscape Architecture + Land Use Planning <br />EC 9.6795 Stormwater - Source Controls <br />The proposed development does not meet any of the criteria listed in the “Applicability” portion of <br />this code section and therefore does not include design features that specifically address this <br />issue. <br /> <br />EC 9.6796 Dedication of Stormwater Easements <br />(2) Applicability. Stormwater easement standards set forth in EC 9.6796(3) apply to <br />all land use applications and development permits that result in the construction <br />of a city maintained stormwater management facility. <br />The proposed stormwater treatment facility shown on Lot H will be maintained by <br />the City of Eugene as per discussions with City of Eugene Public Works during <br />the Project Consultation Meeting. <br />(3) Standards. The applicant must dedicate public easements approved by the city <br />over city maintained stormwater management facilities provided the city makes <br />findings to demonstrate consistency with constitutional requirements. The <br />conveyance of ownership or dedication of easements may be required in any of <br />the following circumstances: <br /> <br />(d) To provide necessary drainage from the public right-of-way. <br /> <br />(e) Where the facility will provide treatment for runoff from the public right-of-way <br />and the City will be maintaining the facility. <br />Both (d) and (e) apply. Stormwater from proposed public road Street B will be <br />directed to the stormwater treatment facility in Lot H. The stormwater <br />treatment facility to be maintained by the City of Eugene on Lot H is also <br />covered by a Public Utility Easement. <br /> <br />EC 9.6797 Stormwater Operation and Maintenance. <br />(1) All stormwater facilities shall be operated and maintained in accordance with EC Chapters 6 <br />and 7, and the Stormwater Management Manual. <br /> <br />(2) Unless the applicant proposes private maintenance of the facility, a stormwater facility that <br />will provide treatment for runoff from the public right-of-way shall be: <br /> <br />(a) Designed and constructed through the Privately Engineered Public Improvement (PEPI) <br />process; and <br />The PEPI process will be utilized to design and get approval for the publicly maintained <br />facility on Lot H. <br /> <br />(b) Located in public rights of way or public easements dedicated in accordance with EC <br />9.6796; and <br />The stormwater facility on Lot H will be located in a dedicated PUE. <br /> <br />(c) Selected from the list of stormwater facilities identified in the Stormwater Management <br />Manual as a type of facility that the City will operate and maintain. <br />This design will be reviewed and approved through the PEPI process and selected from <br />the list of stormwater facilities identified in the Stormwater Management Manual. <br /> <br />An approved adjustment to a standard pursuant to the provisions beginning at EC 9.8015 of <br />this land use code constitutes compliance with the standard. <br />An Adjustment Review Application has been submitted for EC 9.6882. <br /> <br />(3) The proposed subdivision will not cause any existing improvements on proposed lots to be <br />inconsistent with applicable standards in this land use code. <br />The site is vacant. There are no existing improvements on proposed lots. <br />
