Floral Hill Terrace Subdivision <br />Tentative Subdivision – Written Statement 5 <br />May 15, 2026 <br /> <br /> <br />Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 <br />Landscape Architecture + Land Use Planning <br />WRITTEN STATEMENT <br />The application is to be reviewed under the Housing/Clear and Objective Criteria <br /> <br />SUBDIVISION, TENTATIVE <br />The following is the written statement responding to the Tentative Subdivision criteria. <br /> <br />EC 9.8505 Applicability of Subdivision, Tentative Plan Applications. <br />(1) Except as provided in subsections (2) and (3) of this section, requests to create 4 or more lots shall be <br />subject to the subdivision provisions of this land use code and shall follow a Type II application process. <br />This is an application to create 12 residential lots therefore it is subject to the subdivision provisions of <br />this land use code. <br /> <br />(2) Subdivision applications that meet the approval criteria in EC 9.8515(13) or EC 9.8520(9) may be <br />processed pursuant to the expedited land division procedures in EC 9.7900 through EC 9.7925. <br />EC 9.8520(9) If the applicant elects to use the expedited land division procedures in EC 9.7900 through <br />EC 9.7925, the application must meet the following additional approval criteria in subparagraphs (a)–(c): <br />(a) The subdivision only includes land zoned for residential uses; <br />The subject property is zone R-1 and encompasses the entire site. The subdivision only includes land <br />zoned for residential uses. <br /> <br />(b) The lots created will only be developed for residential use, including recreational or open space <br />accessory to residential use; and <br />The lots will only be developed for residential use. The Middle Housing Land Division applications <br />submitted concurrently with this Subdivision application create individual Middle Housing lots. Only <br />housing for residential use can and will be developed on these lots. <br /> <br />(c) The lots created will either allow construction of residential units at a density of 80 percent or more of <br />the maximum net density per acre permitted in the zone and identified in Table 9.2750; or, existing <br />and future dwellings located on the property that is the subject of the subdivision application will be <br />sold or rented to households with incomes below 120 percent of the median family income for Lane <br />County. <br />Future dwellings will be sold to households with incomes at or below 80% of the median income for <br />Lane County. <br /> <br />(3) Concurrent applications may be processed as provided in EC 9.8005. <br />The Subdivision application is being processed concurrently with an Adjustment Review application. <br /> <br />(4) A tentative plan application to subdivide land may be submitted and reviewed concurrently with a tentative <br />PUD application following a Type III application procedure. . . . . <br /> Not applicable. There is no requirement for an application for a PUD. <br /> <br />(5) If a subdivision tentative plan application is not reviewed concurrently with a tentative PUD application, no <br />development permit shall be issued by the city prior to approval of the tentative subdivision application.,,, <br /> The subdivision tentative plan is not being submitted concurrently with a tentative PUD. No development <br />permits shall be issued prior to approval of the tentative subdivision application. <br /> <br />EC 9.8510 Subdivision, Tentative Plan Application Requirements. In addition to the provisions in EC <br />9.7010 Application Filing, the following specific requirements shall apply to tentative subdivision plan <br />applications: <br />(1) All tentative subdivision applications shall be prepared by an Oregon licensed land surveyor and shall <br />include a preliminary title report. <br />This application is being prepared by Schirmer Consulting, LLC., an Oregon licensed landscape <br />architect and Roberts Surveying, Inc., an Oregon licensed land surveyor. <br /> <br />Preliminary Title Report is attached. <br />
