idep Horn <br />Page 8 <br />All three proposed parcels maintain primary frontage along Valley River Way, an existing, <br />improved public right-of-way. The Project retains the existing vehicular, pedestrian and bicyclist <br />access arrangement. <br />(d) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard Areas <br />— Standards. <br />Applicant Response: A portion of the western side of the subject site is located within FEMA Flood <br />Hazard Zone AE, a Special Flood Hazard Area. However, the proposed Minor Partition - Tentative is <br />intended to establish an additional two parcels along the property's eastern property boundary, over <br />1,400 feet from the nearest extent of mapped Zone AE boundary. Furthermore, no physical <br />development is proposed within proximity of the mapped Zone AE boundary. Accordingly, the permit <br />requirements and standards in this Section do not apply. <br />(e) EC 9.6710 Geological and Geotechnical Analysis. <br />Applicant Response: Pursuant to EC 9.6710(2), the proposed Minor Partition - Tentative is exempt <br />from the geological and geotechnical analysis requirements in this Section. <br />(f) EC 9.6735 Public Access Required. <br />Applicant Response: All proposed parcels will maintain frontage on Valley River Way, an existing, <br />improved public right-of-way. All proposed parcels include existing commercial development, and the <br />proposal does not include any changes of use, building additions, or alterations that would result in an <br />increase in peak hour trip generation. The Project complies with the standards in this Section. <br />(g) EC 9.6750 Special Setback Standards. <br />Applicant Response: All proposed parcels will maintain frontage on Valley River Way, an existing, <br />improved public right-of-way. Proposed Parcels 2 and 3 include existing commercial buildings within <br />proximity to the Valley River Way right-of-way. The Project does not propose any additions or <br />alterations to the existing buildings on Parcels 2 and 3 that would reduce the existing front yard <br />setback areas on these parcels. <br />(h) EC 9.6775 Underground Utilities. <br />Applicant Response: All proposed parcels are currently developed and include existing commercial <br />buildings that are served by underground utilities, in accordance with the requirements in this Section. <br />Applicant acknowledges that any future development must continue to be served by underground <br />utilities, in accordance with the provisions in this Section. <br />(i) EC 9.6780 Vision Clearance Area. <br />Applicant Response: The subject property is not located at an intersection; therefore, the standards <br />in this Section do not apply. <br />6) EC 9.6791 through 9.6797 regarding stormwater flood control, quality, flow control for <br />headwaters area, oil control, source control,. easements, and operation and maintenance. <br />Applicant Response: All proposed parcels are currently developed and include existing commercial <br />development served by existing stormwater management facilities. The Project involves a Minor <br />Partition - Tentative only and does not include any physical development that would alter or add <br />impervious surfaces. Applicant acknowledges that any future development would be required to <br />comply with the requirements in EC 9.6791 through 9.6797. <br />(k) All other applicable development standards for features explicitly included in the <br />application. <br />
