Kim ley))) Horn Page 9 <br />Applicant Response: This consistency memo addresses and confirms compliance with all <br />applicable development standards for the proposed Minor Partition in the C-2 zone. <br />(1) The applicable adopted plan policies beginning at EC 9.9500. <br />Applicant Response: The Metro Plan and Willakenzie Area Plan are the adopted plans applicable to <br />the subject property. There are no specific policies within these plans, as detailed in EC 9.9560 and <br />9.9700, which would constitute approval criteria for the Project. Accordingly, the proposed Minor <br />Partition - Tentative complies with the requirements in this Section. <br />An approved adjustment to a standard pursuant to the provisions beginning at EC 9.8015 of this land use <br />code constitutes compliance with the standard. <br />(2) The proposed partition will not create anew nonconforming situation. <br />Applicant Response: The proposed partition will not create a new nonconforming situation. The <br />proposed Minor Partition - Tentative does not include any new physical development on the subject <br />property, and the findings below are intended to address the development standards that could <br />potentially be affected by the creation of new parcel boundaries: <br />EC 9.2170(4), Setbacks <br />The subject property is located within the C-2 zone and development is subject to the applicable <br />setbacks in Table 9.2170, The subject property and all surrounding parcels are located within the <br />C-2 zone and, pursuant to EC 9.2170(4)(d), are not subject to a minimum interior yard setback <br />requirement. All proposed parcels include existing development and no building additions or <br />alterations are proposed. The proposed Minor Partition -Tentative will not reduce or increase the <br />existing front yard setback areas; therefore, the Project will not exacerbate any existing or create <br />any new setback non -conformities. <br />9.2170(5), Landscaping <br />The proposed Minor Partition — Tentative does not include any new buildings, additions, or <br />alterations; therefore, the landscaping requirements in EC 9.2170(5) do not apply and the Project <br />will not create any new nonconforming situations. <br />(3) Partitions abutting collector and arterial streets comply with access management guidelines of the <br />agency having jurisdiction over the street. <br />Applicant Response: No new streets, alleys, or driveways are proposed; therefore, the proposed <br />Minor Partition - Tentative complies with the relevant access management guidelines. <br />(4) if the provisions of EC 9.8215(1) require a public street, or if the applicant proposes the creation <br />of a public street, ail of the following criteria also apply: <br />Applicant Response: The proposed Minor Partition -Tentative does not require, and the Applicant is <br />not proposing, a new public street. The criteria in this Section do not apply. <br />(5) As far as is practicable, lot side lines run at right angles to the street upon which the lots face, <br />except that on curved streets they are radial to the curve. <br />Applicant Response: Proposed Parcels 2 and 3 include side lot lines that run at right angles to their <br />front lot lines with Valley River Way, in compliance with the requirement in this Section.
