Decision <br />Based on the available information and evidence, and based on the preceding findings of <br />compliance with applicable approval criteria and standards, the Standards Review and Final <br />Planned Unit Development are APPROVED with the following conditions: <br />Conditions related to Standards Review (SDR 25-02) <br />1. The applicant shall obtain an Erosion Prevention permit prior to the initiation of any <br />development activities in the Conservation Setback as shown on the site plans. <br />2. Prior to final site plan approval, the applicant shall submit a revised final site plan that <br />identifies the Conservation Area in between the southern property line and the southern <br />edge of the road and sidewalk. The revised site plans shall also show replanting details <br />consistent with the requirement at EC 9.4980(2)(c). <br />3. Prior to site plan approval, the applicant shall submit a revised final site plan that <br />includes tree and plant species that are selected from the Native and Non -Native Plant List, <br />Exhibit F to Ordinance No. 20351. <br />4. Prior to Final PUD approval, the following note shall be added to the final site plans: <br />"Any disturbed 'areas within the Conservation Setback shall be replanted within 90 days of <br />any clearing or vegetation removal activities, unless otherwise approved by the Eugene <br />Planning Director." <br />5. Prior to final site plan approval, the applicant shall submit a revised site plan that <br />shows staging area(s) for heavy machinery. Alternatively, the applicant may include a note <br />on the final site plan stating, "No staging areas for heavy equipment will be located within <br />a Conservation Area." <br />6. Prior to final site plan approval, the applicant shall submit a revised site plan that <br />shows the location of access for and use of heavy machinery within the extent of the <br />Conservation Area impacted by the construction of the road. <br />7. Prior to final site plan approval, the following note shall be added to the final site <br />plans: "Heavy machinery may only be used in the /WR conservation areas between .tune 15 <br />and September 30 and will not be used outside of the area shown on this site plan for <br />staging and access to the construction impact area. <br />8. Prior to final site plan approval, the applicant shall add a note to the final site plans <br />that states, "Petroleum products, chemicals, or other deleterious materials used in the <br />construction process shall not be allowed to enter a stream or wetland that is within a /WR <br />conservation area." <br />9. Prior to final plat approval, the applicant shall add a note to the final site plans that <br />states, "All lighting within the /WR Conservation Area shall meet the lighting standards <br />under EC 9.4980(8)(b) and EC 9.4980(8)(c)." <br />March 2026 Findings & Decision of the Planning Director Page 27 of 28 <br />Braewood Hills Third Addition (SDR 25-02 & PDF 25-01) <br />
