12. Prior to final site plan approval, the final plans shall be revised so that all public <br />stormwater facilities are located in either public right-of-way, public utility easements, <br />or public stormwater easements in compliance with EC 9.6796. <br />Based on the above findings and condition of approval, this condition will be met. <br />27. Prior to final PUD approval, the applicant shall submit an updated site plan that includes <br />the following notes: <br />"The approved stormwater system shall be designed and sized by a civil engineer for <br />the full build -out of the project including 20% of each lot assumed to be impervious <br />surface area. If a lot is proposed to be developed with more than 20% impervious <br />surface area, then additional on -site detention is required. Stormwater runoff from <br />private facilities may also be combined with runoff from the public street (Randy <br />Lane), so long as the public detention system is sized and designed in accordance with <br />applicable Public Improvement Design Standards." <br />"In addition to the on -site detention requirements noted above, all subsequent site <br />development permits, building permits, and Privately Engineered Public Improvement <br />(PEPI) permits for development of the PUD shall demonstrate compliance with <br />applicable stormwater standards at EC 9.6791 through 9.6797 and requirements of the <br />Stormwater Management Manual." <br />Both required notes are included as notes 6 and 7 on sheet L2.0. Therefore, this condition is <br />met. <br />Based on the above findings and conditions of approval, EC 9.8365(1) is met. <br />(2) For final PUDs not associated with a land division, public improvements as required by <br />this land use code or as a condition of tentative plan approval will be completed prior to <br />issuance of a development permit, or: <br />(a) A performance bond or suitable substitute as agreed upon by the city has been <br />filed with the city finance officer in an amount sufficient to assure the completion of <br />all required public improvements; or <br />(b) A petition for public improvements and for the assessment of the real property for <br />the improvements has been signed by the property owner seeking the subdivision, <br />and the petition has been accepted by the city engineer. <br />This final PUD includes a land division.
