An updated stormwater report (dated August 2025) was submitted and demonstrates how the <br />shared driveways will satisfy EC9.6792(3)(c). Therefore, this condition has been met. <br />18. Prior to final PUD approval, the applicant shall obtain Type II Standards Review approval <br />for the proposed public street extension of Randy Lane and any other utility crossings or <br />other allowed improvements within the protected /WR conservation area, subject to the <br />applicable standards at EC 9.4900-9.4980. <br />A Standards Review application for the street extension of Randy Lane was submitted <br />concurrent with this Final Planned Unit Development application and reviewed and approved in <br />section 1 of this decision. Therefore, with concurrent approval of the Standards Review, this <br />condition is met. <br />19. All future building permits for Lots 30 through 35 shall depict the Goal 5 resource and its <br />40-foot setback from top of bank and shall include site plans showing the location of <br />protective fencing subject to the applicable standards at EC 9.4920-9.4930. <br />This requirement will be assessed with each future building permit for lots 30 through 35, <br />Therefore, this condition will be met. <br />20. The final PUD plans shall include the following note: "Compliance with all applicable <br />development standards, special use limitations, and other general development <br />standards for single -unit or middle housing residential dwelling types shall be <br />demonstrated at the time of future building permit on each individual lot." <br />The required note is shown on Sheet L2.0 of the site plans. Therefore, this condition is met. <br />21. The final PUD plans shall be revised to remove any references to middle housing lots to <br />be created on land above 901-foot elevation. The final PUD plans shall also include a note <br />stating that: "No development of middle housing, single -unit dwellings, or any other <br />development, including but not limited to land divisions, may occur on any land above <br />901-feet in elevation." <br />The required note is shown on Sheet L2.0 of the site plans. Therefore, this condition has been <br />met. <br />22. The final PUD plans shall include the following note: "No site alteration is allowed prior to <br />final PUD approval. This prohibition includes site grading and the removal of trees and <br />other vegetation, as well as any impacts to wetlands and the protected stream on the <br />subject property including changes to the existing drainage pattern.
