included in the proposed JAM which creates the private street, or alternatively, may be <br />dedicated as a Public Emergency Access Easement on a standard City form. <br />The proposed JAM includes provisions for public emergency access. Therefore, this condition <br />has been met. <br />7. Prior to final plat approval, the applicant shall dedicate a 14-foot Public Utility Easement <br />or Public Wastewater Easement that will encumber the proposed public wastewater <br />system. The required easement shall also be shown on revised final PUD plans. <br />The plans depict a variable width PUE over the entirety of Lot A. As discussed above and under <br />condition of approval 5, the JAM will need to be revised to either define a blanket PUE with a <br />private utility corridor or a blanket private utility easement with a PUE corridor, therefore the <br />following condition of approval is warranted: <br />11. Prior to final site plan approval, the final site plans shall be revised to either define a <br />blanket PUE with a private utility corridor or a blanket private utility easement with a <br />PUE corridor. <br />Based on the above findings and condition of approval, this condition will be met. <br />8. The final PUD site plans shall include the following note: "No building, structure, tree or <br />other obstruction shall be placed or located on or in a Public Utility Easement, consistent <br />with EC 9.6500(3)". <br />The required note is shown on Sheet L2.0 of the site plans. Therefore, this condition has been <br />met. <br />9. The final PUD site plans shall include the following note: "Compliance with public <br />improvement requirements shall be demonstrated in accordance with EC 9.6505 as part <br />of the permitting process for development within the PUD including Privately Engineered <br />Public Improvement (PEPI) Permits, Site Development Permits and Building Permits." <br />The required note is shown on Sheet L2.0 of the site plans. Therefore, this condition has been <br />met. <br />10.
