5) Separate utilities are provided for each dwelling unit. <br />Separate utilities are proposed and shown on the tentative site plan. In order to ensure <br />compliance with this criterion, the following condition is warranted: <br />3. The following note shall be added to the final site plan, "Separate utilities shall <br />be provided for each dwelling unit". <br />Based on these findings and condition, this criterion is satisfied. <br />6) The middle housing land division results in one dwelling unit on each middle housing <br />lot, except lots, parcels or tracts that include a common area. Lots, parcels or tracts that <br />include a common area, but do not include a dwelling unit, are permitted. <br />The proposed Middle Housing Land Division will result in four Middle Housing Lots, each of <br />which can be developed with a dwelling unit. The result is one dwelling unit on each Middle <br />Housing Lot. This criterion is met. <br />7) The application demonstrates that buildings or structures on the middle housing <br />lots created by the middle housing land division will comply with applicable building code <br />provisions related to new property lines; and, notwithstanding the creation of new lots or <br />parcels, that structures or buildings located on the middle housing lots will comply with the <br />Oregon Residential Specialty Code. <br />The property is currently under construction and appears to be in alignment with the newly <br />proposed Middle Housing Lot lines. During building permit review the four structures were <br />reviewed for proper lot line separation and found to be in compliance with the Oregon <br />Residential Specialty Code. <br />Based on the above findings, this criterion is met. <br />8) The following notes are included on the tentative plan: <br />a) The middle housing lots shown on the tentative plan were created pursuant to a <br />middle housing land division and may not be further divided. <br />b) The middle housing developed on the middle housing lots shown on the tentative <br />plan shall remain middle housing and shall not be considered to be any other housing <br />type as a result of the middle housing land division. <br />The submitted Tentative Middle Housing Land Division Plan (i.e. Tentative Partition Plan) <br />contains the notes listed above. This proposal is a Tentative Middle Housing Land Division and <br />not a Tentative Partition, but is required by Oregon Revised Statutes Chapter 92 to be platted <br />under the term "partition."
