9) The proposed middle housing land division will not cause any existing improvements on <br />the middle housing lots to be inconsistent with applicable standards in this land use code. <br />As discussed in the above sections of this decision, the proposed Middle Housing Land Division <br />will not create any new inconsistencies with Eugene's Land Use Code, with regard to existing <br />improvements on the proposed Middle Housing Lots. Based on these findings, this criterion is <br />met. <br />Decision <br />Based on the available information, evidence, and preceding findings of compliance with <br />applicable approval criteria and standards, the Tentative Middle Housing Land Division is <br />APPROVED subject to the following conditions: <br />1. The applicant shall provide evidence that separate water service lines are provided to <br />Lots 1 through 4 within the bounds of each respective lot. Alternatively, a reciprocal <br />private utility easement may be provided from Lots 1 through 4 for the benefit of each <br />lot. <br />2. The applicant will provide evidence that separate wastewater service lines are provided <br />to Lots 1 through 4. Alternatively, a private utility easement may be provided to serve <br />Lots 1 through 4. <br />3. The following note shall be added to the final site plan, "Separate utilities shall be <br />provided for each dwelling unit". <br />Approved By <br />Jeff Ge4pk, Pr ncipal PI <br />Post Approval <br />for the Eugene Planning Director <br />l0 /3A."75- <br />Date <br />Pursuant to EC 9.7920(4), the decision of the Planning Director is effective on the 15th day after <br />notice of the decision is mailed, unless appealed according to the procedures in EC 9.7640. The <br />tentative Middle Housing Land Division approval shall remain effective for 36 months following <br />the effective date of approval, in accordance with EC 9.7230. <br />In this instance, a final site plan and performance agreement will be required in accordance <br />with 9.7025.
