Alternatively, a reciprocal private utility easement may be provided from Lots 1 <br />through 4 for the benefit of each lot. <br />Wastewater: As proposed, based on the tentative site plan the applicant proposes to <br />connect to the existing public wastewater system within East 22nd Avenue. A private <br />wastewater configuration is shown within a proposed 7-foot private utility easement <br />along the frontage of East 22"d Avenue to allow Lots 1 through 4 access to wastewater <br />service. No development of the dwelling units is shown as part of this application. <br />However, the proposed configuration for future development does appear to be a <br />shared wastewater connection. Any portion of a shared wastewater service must be <br />covered by an easement that ensures access to all parties for maintenance and service <br />of the shared line, as well as dictating roles, rights and responsible parties for repairs <br />and cost; therefore, the following condition is warranted: <br />2. The applicant will provide evidence that separate wastewater service lines are <br />provided to Lots 1 through 4. Alternatively, a private utility easement may be <br />provided to serve Lots 1 through 4. <br />Electric: Electrical service is proposed to be provided to the subject property within a <br />proposed 5-foot EWEB easement located on Lots 1, 2 and 3 to allow Lots 1 through 4 <br />access to electric service. <br />Stormwater: No stormwater infrastructure is shown on the applicant's site plan. Any <br />future development will be subject to review for consistency with applicable codes at the <br />time of building permit application. This standard is met. <br />Based on the above findings, and conditions of approval, the proposed Middle Housing Land <br />Division complies with this criterion. <br />b) Easements for pedestrian access from each dwelling unit to a street; <br />East 22nd Avenue, which is a public street, borders Lots 1 through 4. Alder Street, which is also <br />a public street, only fronts Lot 1. Because all lots have frontage onto a public street, this <br />criterion is met. <br />c) Easements necessary for any common areas or shared building elements; <br />As there are no known shared building elements or common areas, as provided in the <br />applicant's written narrative, this criterion does not apply. <br />d) Easements necessary for any shared driveways or parking. <br />As no shared driveways or parking areas exist on the subject property or are proposed through <br />this Middle Housing Land Division, this criterion does not apply. <br />October 2025 Findings & Decision: 2205 Alder (MHT 25-18) Page 8 of 12
