3. Streets and Alleys and 4. Sidewalks <br />EC 9.6505(3) requires that all streets in and adjacent to the development site be paved to the <br />width specified in EC 9.6870 and improved according to adopted standards and specifications <br />pursuant to Chapter 7 of the Eugene Code. The improvements are to include drainage of all <br />such streets and alleys, as well as curbs and gutters, sidewalks, street trees, and streetlights <br />designed in accordance with the Design Standards and Guidelines for Eugene Streets, Sidewalks, <br />Bikeways and Accessways and standards and specifications adopted pursuant to Chapter 7 of <br />the Eugene Code and other adopted plans and policies. <br />East 22nd Avenue is a medium volume residential street owned and maintained by the city of <br />Eugene and is fully improved to City standards, consisting of 34 feet of paving, curb and gutters, <br />setback sidewalks, street lights and street trees. <br />Alder Street is a low volume residential street owned and maintained by the city of Eugene and <br />is fully improved to City standards, consisting of 24 feet of paving, curb and gutters, setback <br />sidewalks, street lights and street trees. <br />Based on the above findings, the proposed Middle Housing Land Division complies with the <br />standards of EC 9.6505 (3) — (4). <br />5. Bicycle Paths and Accessways <br />No bicycle path or accessways are proposed or required with this application. Therefore, this <br />standard does not apply. <br />c) EC 9.6805, Dedication of Public Ways; and <br />EC 9.8194(3)(c) requires the applicant to comply with the Standards for Streets, Alleys, and <br />Other Public Ways, which are set forth in EC 9.6805. Pursuant to EC 9.6805, as a condition of <br />any development, the City may require dedication of public ways for bicycle and/or pedestrian <br />use as well as for streets and alleys, provided the City makes findings to demonstrate <br />consistency with constitutional requirements. The public ways for streets to be dedicated to the <br />public by the applicant shall conform to the adopted right-of-way map and EC Table 9.6870. <br />East 22nd Avenue is not identified on the adopted Street Classification Map (Fig. 60 of the <br />Transportation System Plan) and functions as a medium volume residential street with a <br />required right-of-way width between 50-60 feet and paving between 20-34 feet. East 22nd <br />Avenue has 33 feet of right-of-way on the south side of centerline with a total right-of-way <br />width of 66 feet, providing the maximum required width for its classification type. Based on the <br />available information, no further right-of-way or setbacks will be required. <br />Alder Street is not identified on the adopted Street Classification Map (Fig. 60 of the <br />Transportation System Plan) and functions as a low volume residential street with a required <br />October 2025 Findings & Decision: 2205 Alder (MHT 25-18) Page 6 of 12
