Evaluation <br />This request is subject to the Expedited Land Division/Middle Housing Land Division application <br />procedures, which are primarily addressed starting at Eugene Code (EC) 9.7900. The following <br />evaluation also addresses details of the proposal in the context of compliance with the <br />applicable approval criteria and related standards. <br />In accordance with EC 9.8194, the Planning Director shall approve, conditionally approve, or <br />deny the tentative Middle Housing Land Division application based on compliance with the <br />listed criteria. Those criteria are provided below (in bold) with respective findings that address <br />compliance. <br />EC 9.8194 Middle Housing Land Division, Tentative Plan Approval Criteria. <br />The planning director shall approve, conditionally approve, or deny the middle housing <br />land division tentative plan application based on compliance with the following criteria: <br />1) If the property to be divided is not yet developed with middle housing: <br />a) The application proposes development of middle housing on the lot or parcel to be <br />divided; and <br />b) The lot or parcel to be divided is developable with middle housing consistent with <br />the following: <br />1. EC 9.2750; <br />2. EC 9.2751; <br />3. EC 9.2760; <br />4. EC 9.2761; <br />S. EC 9.2775; and <br />6. EC 9.5550 <br />The proposal will site four dwellings on the property, making it a fourplex. In accordance with <br />EC 9.2750 and 9.2750, the maximum density standard does not apply to middle housing, and in <br />accordance with EC 9.2741, a fourplex is permitted on the lot based on the parent lot area <br />which exceeds 4,500 square feet. The property is an existing legal lot of record, complying with <br />EC 9.2760 and 9.2761. The applicant's site plan includes notes that ensure compliance with EC <br />9.2777. With the recently approved building permit (file # 25-02452-01), the applicant <br />adequately demonstrated the site dimensions and proposed buildings met the requirement of <br />EC 9.5550. <br />Based on these finding, the applicant has demonstrated a fourplex is developable on the site <br />consistent with these standards. <br />2) If the property to be divided is developed with middle housing: <br />a) The middle housing complies with EC 9.5550; or <br />October 2025 Findings & Decision: 2205 Alder (MHT 25-18) Page 4 of 12
