The subject property is developed with an existing single unit dwelling, and is therefore required to comply with the applicable requirements of the Oregon Residential Specialty Code ORSC). According to referral comments from Building and Permit Services staff, the proposed Middle Housing Land Division does not conflict with any applicable ORSC provisions, as each existing dwelling is located a sufficient distance from the new property line established between the dwellings. Any future development will be subject to review for consistency with applicable codes at the time of building permit application. Based on the above findings, this criterion is met. 8) The following notes are included on the tentative plan: a) The middle housing lots shown on the tentative plan were created pursuant to a middle housing land division and may not be further divided. b) The middle housing developed on the middle housing lots shown on the tentative plan shall remain middle housing and shall not be considered to be any other housing type as a result of the middle housing land division. The submitted Tentative Middle Housing Land Division Plan (i.e. Tentative Partition Plan) contains the notes listed above. This proposal is a Tentative Middle Housing Land Division and not a Tentative Partition, but is required by Oregon Revised Statutes Chapter 92 to be platted under the term "partition." This criterion is met. 9) The proposed middle housing land division will not cause any existing improvements on the middle housing lots to be inconsistent with applicable standards in this land use code. As discussed in the above sections of this decision, the proposed Middle Housing Land Division will not create any new inconsistencies with Eugene's Land Use Code, with regard to existing improvements on the proposed Middle Housing Lots.
