Middle Housing Lots (Parcels) 1 and 3 have frontage on Sunshine Acres Road, a public street. <br />Middle Housing Lot (Parcel) 2 does not have frontage to a street. Based on the tentative site <br />plan, the applicant has proposed a variable width private access and utility easement <br />encumbering Middle Housing Lot (Parcel) 3 to provide access from Sunshine Acres Road to <br />Middle Housing Lot (Parcel) 2. To ensure that the above criterion is met, the following condition <br />of approval is warranted: <br />4. On the final plat, the applicant shall include provisions for pedestrian <br />ingress/egress in the proposed variable width private access easement and <br />utility easement. <br />This criterion is met as conditioned. <br />c) Easements necessary for any common areas or shared building elements; <br />As there are no known shared building elements or common areas, as provided in the <br />applicant's written narrative, this criterion does not apply. <br />d) Easements necessary for any shared driveways or parking. <br />As there are no shared driveway or parking spaces proposed at the time of this application, this <br />criterion does not apply. <br />Based on the above findings and future permit requirements, the proposed Middle Housing <br />Land Division complies with this criterion. <br />5) Separate utilities are provided for each dwelling unit. <br />As provided in the applicant's written narrative and site plan, each dwelling unit will have <br />separate utilities. Based on these findings and future permitting requirements, this criterion is <br />satisfied. <br />6) The middle housing land division results in one dwelling unit on each middle housing <br />lot, except lots, parcels or tracts that include a common area. Lots, parcels or tracts that <br />include a common area, but do not include a dwelling unit, are permitted. <br />The proposed Middle Housing Land Division will result in three Middle Housing Lots, each of <br />which will developed with one dwelling unit (one existing, two to be proposed in the future). <br />The result is one existing dwelling unit on each Middle Housing Lot. This criterion is met. <br />7) The application demonstrates that buildings or structures on the middle housing <br />lots created by the middle housing land division will comply with applicable building code <br />provisions related to new property lines; and, notwithstanding the creation of new lots or <br />parcels, that structures or buildings located on the middle housing lots will comply with the <br />Oregon Residential Specialty Code. <br />December 2025 Findings & Decision: 310 Sunshine Acres (MHT 25-33) Page 9 of 13
