Decision <br />Based on the available information, evidence, and preceding findings of compliance with <br />applicable approval criteria and standards, the Tentative Middle Housing Land Division is <br />APPROVED subject to the following conditions: <br />1. The applicant shall submit an Irrevocable Petition for public improvements in Sunshine <br />Acres Drive to include street trees. <br />2. Prior to final plat, the applicant will provide evidence that separate water service lines are <br />provided to Middle Housing Lots (Parcels) 1-3 within the bounds of each respective lot. <br />Alternatively, a reciprocal private utility easement may be provided from Middle Housing <br />Lots (Parcels) 1-3 for the benefit of Middle Housing Lots (Parcels) 1-3. <br />3. Prior to final plat, and to achieve compliance with EC 9.8194(4)(b), the following options are <br />available: (1) the applicant shall provide documentation demonstrating the private <br />wastewater service for Parcel 1 has been relocated into a private utility easement; or (2) the <br />applicant shall submit a deed restriction holding Middle Housing Lots (Parcels) 1-3 in <br />common ownership as a single development site until the requirements and recorded <br />easements are provided to the City as required under option (1) above. <br />4. On the final plat, the applicant shall include provisions for pedestrian ingress/egress in the <br />proposed variable width private access easement and utility easement. <br />Approved By <br />Jeff Geer, PrincipalpilaOiner, for the Eugene Planning Director <br />Post Approval <br />12/8/2025 <br />Date <br />The applicant has requested review of this Middle Housing Land Division application subject to <br />the amended Expedited Land Division procedures of ORS 197.365, as amended by House Bill <br />2138. Pursuant to House Bill 2138, this decision may only be appealed by the applicant. Appeals <br />to Expedited Land Division determinations are subject to the amended provisions of ORS <br />197.830 to 197.855, as amended by House Bill 2138. Appeals of Expedited Land Division <br />decisions are subject to review by the Oregon Land Use Board of Appeals (LUBA). The decision <br />of the Planning Director is final on the local level. The Tentative Middle Housing Land Division <br />approval shall remain effective for 36 months following the effective date of approval, in <br />accordance with EC 9.7230. <br />A final site plan and performance agreement will be required for this Middle Housing Land <br />Division in accordance with EC 9.7025.
