Wastewater: <br />Public wastewater is available along the east property line of Middle Housing Lot (Parcel) 1 in <br />Sunshine Acres Drive and to the south of Middle Housing Lot (Parcel) 3. In its current <br />configuration, the existing dwelling on Middle Housing Lot (Parcel) 1 is connected to the 10-inch <br />wastewater service line to the south of Middle Housing Lot (Parcel) 3. Based on the tentative <br />site plan, the applicant proposes to connect to the existing 8-inch wastewater service line in <br />Sunshine Acres Drive across Middle Housing Lot (Parcel) 3 within a variable width private access <br />and utility easement to allow Middle Housing Lots (Parcels) 1 and 2 access to wastewater <br />service. <br />Further, the applicant proposes Middle Housing Lot (Parcel) 3 will be served by a single service <br />line that is connected to the 10-inch public main within the 50-feet sewer easement to the <br />south of development site. <br />No development of the dwelling units is shown as part of this application. However, the <br />proposed configuration for future development does not appear to be a shared wastewater <br />connection. To ensure that a wastewater line is fully available to each dwelling for access and <br />maintenance on lots owned by separate parties, the following condition is warranted: <br />3. Prior to final plat, and to achieve compliance with EC 9.8194(4)(b), the following <br />options are available: (1) the applicant shall provide documentation <br />demonstrating the private wastewater service for Parcel 1 has been relocated <br />into a private utility easement; or (2) the applicant shall submit a deed <br />restriction holding Middle Housing Lots (Parcels) 1-3 in common ownership as a <br />single development site until the requirements and recorded easements are <br />provided to the City as required under option (1) above. <br />Electric: Electrical service is currently provided by an overhead line that runs from Sunshine <br />Acres Drive across Middle Housing Lot (Parcel) 3 to the existing dwelling on Middle Housing Lot <br />Parcel) 1. An EWEB easement is proposed and encumbered on Middle Housing Lot (Parcel) 3 to <br />allow Middle Housing Lots (Parcels) 1 and 2 access to electric service. <br />Stormwater: No stormwater infrastructure is shown on the applicant's site plan. Any future <br />development will be subject to review for consistency with applicable codes at the time of <br />building permit application. This standard is met. <br />As an informational item, private utilities serving the parcels shall NOT be placed in a Public <br />Utility Easement (PUE) and Public Utilities must be in a dedicated PUE. <br />Proposed easements will be submitted for City review and approval prior to recording the final <br />plat. <br />Based on the above findings, and conditions of approval, the proposed Middle Housing Land <br />Division complies with this criterion. <br />b) Easements for pedestrian access from each dwelling unit to a street; <br />December 2025 Findings & Decision: 310 Sunshine Acres (MHT 25-33) Page 8 of 13
