Per EC Table <br />9.6870, Low -Volume Residential Local Streets are required to have between 45 and SS feet of <br />right-of-way with a paving width between 20 and 28 feet. Sunshine Acres Drive has an existing <br />right-of-way width of 50 feet and a paving width of 25 feet, which exceeds the minimum right- <br />of-way and paving width required for Low -Volume Residential Local Streets. <br />Since Sunshine Acres Drive meets the minimum required right of way width, no additional <br />right-of-way dedication will be required. Based on these findings, the proposed Middle Housing <br />Land Division complies with the standards of EC 9.6805 Dedication of Public Ways. <br />d) All other applicable development standards for features explicitly included in the <br />application. <br />The proposal does not include new development and there are no other features explicitly <br />included wherein development standards are applicable. Any future development will be <br />subject to review for consistency with applicable codes at the time of building permit <br />application. This standard does not apply. <br />4) The following easements are shown on the tentative plan: <br />a) Easements necessary for locating, accessing, replacing, and servicing all utilities; <br />The proposed Middle Housing Land Division complies with this criterion, as the applicant has <br />proposed adequate easements for locating, accessing, replacing, and servicing all utilities, <br />including water, wastewater, and electric service. As depicted on the site plan, the applicant <br />has proposed a variable width private access and utility easement and an EWEB easement that <br />encumbers Middle Housing Lot (Parcel) 3. <br />As an informational item, it appears that for portions of the EWEB easement and the <br />variable width private access and utility easement proposed, overlap with each other. <br />Staff notes that the private utility easement shall not overlap with EWEB easements, <br />specific locations of these easements will be reviewed at the time of final plat. <br />The following assessment evaluates the needs for easements for utilities. <br />Water: Middle Housing Lot 1 is currently served by the existing water line to the south of <br />subject property to the existing dwelling. As proposed, a private water service line is proposed <br />from the water line in the public accessway south of the development site to allow Middle <br />Housing Lots (Parcels) 2 and 3 access to water service. <br />2. Prior to final plat, the applicant will provide evidence that separate water service <br />lines are provided to Middle Housing Lots (Parcels) 1-3 within the bounds of each <br />respective lot. Alternatively, a reciprocal private utility easement may be <br />provided from Middle Housing Lots (Parcels) 1-3 for the benefit of Middle <br />Housing Lots (Parcels) 1-3. <br />December 2025 Findings & Decision: 310 Sunshine Acres (MHT 25-33) Page 7 of 13
