3. Streets and Alleys and 4. Sidewalks <br />In EC 9.6505(3) requires that all streets in and adjacent to the development site be paved to the <br />width specified in EC 9.6870 and improved according to adopted standards and specifications <br />pursuant to Chapter 7 of the Eugene Code. The improvements are to include drainage of all <br />such streets and alleys, as well as curbs and gutters, sidewalks, street trees, and streetlights <br />designed in accordance with the Design Standards and Guidelines for Eugene Streets, Sidewalks, <br />Bikeways and Accessways and standards and specifications adopted pursuant to Chapter 7 of <br />the Eugene Code and other adopted plans and policies. <br />Middle Housing Lots (Parcels) 1 and 3 have frontage on Sunshine Acres Drive along its eastern <br />boundary along which is a Low -Volume Residential Local Street owned and maintained by the <br />City of Eugene. <br />Sunshine Acres Drive is improved with a 25-foot paving width, curb and gutter, sidewalks and <br />street lights within a 50-foot right of way. <br />To ensure the future improvement potential of Sunshine Acres Drive, the following condition of <br />approval is warranted: <br />1. The applicant shall submit an Irrevocable Petition for public improvements in <br />Sunshine Acres Drive to include street trees. <br />Irrevocable petitions enable the City to initiate a local improvement process and obligate the <br />property owners to pay their proportional share of the street construction costs in the future. <br />The City could construct the street when the majority of benefitting property owners agree to <br />pay for the improvements. <br />Based on the above findings, and Condition of Approval, the proposed Middle Housing Land <br />Division complies with the standards of EC 9.6505 (3)-(4) <br />S. Bicycle Paths and Accessways <br />No bicycle path or accessways are proposed or required with this application. Therefore, this <br />standard does not apply. <br />c) EC 9.6805, Dedication of Public Ways; and <br />EC 9.8194(3)(c) requires the applicant to comply with the Standards for Streets, Alleys, and <br />Other Public Ways, which are set forth in EC 9.6805. Pursuant to EC 9.6805, as a condition of <br />any development, the City may require dedication of public ways for bicycle and/or pedestrian <br />use as well as for streets and alleys, provided the City makes findings to demonstrate <br />consistency with constitutional requirements. The public ways for streets to be dedicated to the <br />public by the applicant shall conform to the adopted right-of-way map and EC Table 9.6870. <br />Sunshine Acres Drive is not identified on the Street Classification Map (Fig. 60 of the 2035 <br />Transportation System Plan (TSP)) or Street Right -of -Way Map (Fig.61 of the Arterial Street <br />December 2025 Findings & Decision: 310 Sunshine Acres (MHT 25-33) Page 6 of 13
