middle housing complied with applicable land use requirements, the criterion in (2)(b) above is <br />met. <br />3) The proposed middle housing land division complies with all of the following: <br />a) EC 9.2777, Middle Housing Lot standards; <br />Each proposed Middle Housing Lot either currently contains, or will contain in the future, one <br />dwelling unit capable of complying with the definition of a middle housing unit. As is stated on <br />the site plan for this application, the proposed Middle Housing Lots may not be further divided. <br />Additionally, there are no frontage, width, or lot area standards for Middle Housing Lots. These <br />standards are met. <br />b) EC 9.6505, Improvements, Specifications for any street frontage improvements <br />required for middle housing lots that abut a street; <br />1. Water Supply. <br />The existing dwelling on Middle Housing Lot (Parcel) 1 is served by the existing water line to the <br />south of Middle Housing Lot (Parcel) 3. Based on the tentative site plan, the applicant proposes <br />connecting Middle Housing Lots (Parcels) 2 and 3 with independent meters located to the south <br />of Middle Housing Lot (Parcel) 3. A Variable width private access and utility easement is shown <br />on the site plan for the service to Middle Housing Lot (Parcels) Lots 1 and 2 crossing the <br />property line of Middle Housing Lot (Parcel) 2. <br />Based on these findings, the standard is met. <br />2. Sewage. <br />EC 9.6505(2) requires all developments to be served by the wastewater sewage system of the <br />City and in compliance with the provisions of Chapter 6 of the Eugene Code. <br />Based on the tentative site plan, the applicant proposes to connect to an existing 8-inch <br />wastewater service line that runs north and south along the east property line of subject <br />property in Sunshine Acres Drive for Middle Housing Lots (Parcels) 1 and 2. The applicant <br />proposes Middle Housing Lot (Parcel) 3 will be served by a single service line that is connected <br />to the 10-inch public main within the 50-feet sewer easement to the south of development site. <br />Staff find the proposal connecting to the existing public wastewater system to be conceptually <br />feasible. Necessary easements for wastewater connection are addressed under EC 9.8194(4)(a) <br />below. <br />Based on these findings, and future permit requirements, the proposed Middle Housing Land <br />Division complies with applicable wastewater requirements. <br />December 2025 Findings & Decision: 310 Sunshine Acres (MHT 25-33) Page 5 of 13
