<br />Applicant’s Written Statement - Lincoln Commons Site Review 4 <br /> <br />where relevant under applicable standards (density, building height, etc.) with a copy of the <br />City’s decision granting approval also included as part of the background for this Site Review <br />application (see Attachment B). <br /> <br />Based upon EC 9.8030, the Planning Director shall approve, conditionally approve, or deny this <br />Type II application, based on compliance with the listed criteria at EC 9.8445. Those criteria are <br />provided below (in bold), including the applicant’s findings addressing compliance with each. <br /> <br />The applicant hopes that the details provided in these findings, along with the site plans and <br />other evidence in the application materials, will simplify the process and meet or exceed the <br />City’s expectations for the level of detail and information necessary for Site Review approval. If <br />the City determines non-compliance with any standards as proposed and described in the <br />findings below, the applicant requests coordination with City staff on any conditions of <br />approval that would remedy potential non-compliance. The applicant welcomes the addition of <br />approval conditions if needed, where they can be justified with adequate findings and based <br />upon a clear and objective reading of the applicable standards. <br /> <br />EC 9.8445(1): The proposal complies with EC 9.5860 Transition Standards. <br /> <br />The proposed multi-unit apartment project is exempt from the Transition Standards at EC <br />9.5860. Based on a review of the triggers for applicability of these standards, none of those <br />situations exist for the subject property or proposed development as listed under EC 9.5860(1). <br /> <br />More specifically, the proposed multi-unit development site does not abut any land zoned R-1, <br />S-C/R-1, or S-RN/LDR, and none of the other types of uses are proposed that would potentially <br />trigger these standards, as listed in EC 9.5860(1)(a) and (b), such as assisted care, university or <br />college dormitories or single room occupancy (SRO). <br /> <br />Based on the available information and findings above, EC 9.8440(1) is inapplicable and the <br />Transition Standards EC 9.5860 do not apply to the proposed development. <br /> <br />EC 9.8445(2): For a proposal for multiple-unit developments, the proposal complies <br />with the standards contained in EC 9.5500 Multiple-Unit Standards. <br /> <br />The subject site is currently vacant, except for a small shop building proposed for removal to <br />make way for the proposed development. As the applicant proposes to create a multi-unit <br />apartment development that will consist of 75 new dwelling units, the development is subject <br />to EC 9.5500 Multiple-Unit Standards. <br /> <br />The applicable standards from EC 9.5500 are included below with findings addressing each . <br />Note that inapplicable standards and irrelevant code provisions from EC 9.5500 are in many <br />cases omitted below for the sake of brevity. Only those multi-unit standards found to be <br />directly relevant and applicable as approval standards for the project, or ones beneficial for <br />additional context about the project, are included below. <br />
