<br />Applicant’s Written Statement - Lincoln Commons Site Review 5 <br /> <br />(3) Building Height. The maximum building heights allowed are those permitted <br />according to the applicable base zone. <br /> <br />The subject site is zoned S-W, Whiteaker Special Area Zone, which is a mixed-use zone that has <br />customized standards depending on the type of use proposed . In this case, the proposed multi- <br />unit residential development is a permitted use subject to Site Review approval and compliance <br />with applicable standards such as maximum building height addressed here (see /SR overlay <br />zone requirements and EC Table 9.3910). The S-W zone’s development standards specify at EC <br />9.3915 that the maximum building height is normally 45 feet, also being subject to applicable <br />Skinner Butte Height Limitations at EC 9.6715. <br /> <br />Based upon the applicant’s recently granted Adjustment Review approval (see ARA 25-29 for <br />Lincoln Commons) the proposed building is allowed up to 54 feet of maximum building height <br />based upon mandatory statutory adjustments now available to housing applicants under <br />Oregon Senate Bill (SB) 1537. In this case, the SB 1537 provisions at Section 38(4)(g)(B) allow <br />up to a 20 percent increase in the S-W zone’s normal maximum height, which at 45 feet results <br />in an additional 9 feet of allowed building height up to 54 feet. As shown on the applicant’s <br />conceptual building elevations submitted with this application (see Attachment A, Sheet s A201 <br />and A202), the proposed building height with the roof level at 49 feet 6 inches and 53 feet to <br />the top of the parapet meets the applicable standards and is consistent with the previously <br />approved adjustment granted for the project. Importantly, the land use code provides that an <br />approved adjustment to a standard constitutes compliance with the standard. <br /> <br />Further review of the related Skinner Butte Height Limitations at EC 9.6715 shows that the <br />subject site is located within that area as described in subsection (3) of the standards, and as <br />proposed, the building height is well below the maximum limit of 500 feet above sea level. The <br />site is almost flat with an existing ground elevation at 425 feet above sea level. With a building <br />height of 53 feet at the top of the parapet wall above the roofline, the maximum height of the <br />building above existing site elevation will be at approximately 478 feet, therefore meeting the <br />standard being under 500 feet above sea level. <br /> <br />Based on the available information, this standard is met. <br /> <br />(4) Minimum and Maximum Building Setbacks. <br />(a) Required Setbacks. The required building setbacks are those required in <br />the applicable base zone. <br /> <br />In accordance with requirements of the S-W zone for the subject property, C-2 development <br />standards apply to this residential development based on EC 9.3915(1). The proposed <br />development meets applicable C-2 requirements at EC 9.2170(4) with a minimum 5-foot <br />setback as shown on the site plans along the length of the building frontage facing Lincoln <br />Street and West 5th Avenue. As proposed, the building is also well-within the maximum setback <br />of 15 feet from the abutting primary street frontages. Interior yard setback requirements (0-10 <br />feet) are also met at over 4 feet from the property line along West 5th Alley right-of-way and
