For lots or parcels abutting an alley that meets the paving width standards of EC 9.6870, access must <br />be taken from the alley (see Figure 9.5550(4)(b)4. Triplex/Fourplex Alley Access). <br /> <br />The subject property is not abutting an alley; this criterion is not applicable to this proposal. <br /> <br />5. Lots or parcels with more than one frontage must comply with the following: <br /> <br />The subject property does not have frontage on more than one street; the criteria contained in Subsection (5) above are not <br />applicable to the proposed middle housing land division. <br /> <br />(c) Entry Orientation and Windows. <br /> <br />1. Entry Orientation. <br /> <br />a. At least one main entrance for each triplex or fourplex structure must meet the standards in <br />subparagraphs b. or c. below. Any detached structure where more than 50 percent of its street- <br />facing facade is separated from the street property line by a dwelling is exempt from meeting <br />these standards. <br /> <br />The future dwelling units will be separated from the Horn Lane property line by two parcels and a dwelling; therefore, the proposal is <br />exempt from meeting standards in subsections (b) and (c). <br /> <br />EC 7.420 Access Connections – Location. <br /> <br />(1) Access Connections to all Street Classifications. Access connections to all street classifications shall be located in <br />accordance with the following standards: <br /> <br />(a) No access connection shall be located to encompass a municipal utility. An access connection may <br />encompass a municipal utility if the applicant either: <br /> <br />No proposed access connections are located to encompass a municipal utility. This criterion does not apply. <br /> <br />(b) Except when an existing lot or parcel frontage is located entirely within an area where the adjacent street <br />grade is over fifteen percent (15%), no access connection shall be located in areas where the street grade is over <br />fifteen percent (15%). If an existing lot or parcel frontage is located entirely within an area where the existing <br />street grade is over fifteen percent (15%), one access connection may be permitted at the point of lowest grade <br />percentage. <br /> <br />The subject property is not located on a street with a slope that exceeds 15% grade. This criterion is not applicable. <br /> <br />(c) If a parcel has frontage on two or more streets of different street classifications, the access connection shall <br />access the street with the lowest classification. The access connection can access the street with the higher <br />classification if the applicant can demonstrate (1), (2) or (3): <br /> <br />The subject property does not have frontage on more than one street. This criterion is not applicable. <br /> <br />(d) Access connections located within five feet of an existing alley connection may be merged with the alley <br />pavement. The combined connection width shall not exceed 35 feet. A public access easement shall be recorded <br />and submitted to the city upon issuance of a permit to construct the access connection. <br /> <br />There are no alleys adjacent to the subject property which would require an access connection to be merged with the alley. This <br />criterion is not applicable. <br />
