Additionally, the property <br />owner may continue to use the area of the public access easement for all such lawful <br />activities that do not significantly affect the right of the public to use the easement area for <br />bicycle and pedestrian access between Alder Street and Hilyard Street. Such lawful activities <br />includes, but are not limited to the following: individuals utilizing this area outside of <br />pedestrian and bicycle transit activities, fire vehicle access, trash and recycling vehicle <br />access, loading and delivery areas, resident building access and security, and below-grade <br />utilities, provided the public accessway easement remains unobstructed. <br /> <br />The 10-foot public pedestrian and bicycle accessway easement is shown on the attached Land Partition <br />Plat plan consistent with the locational requirements of Condition 1. The public pedestrian and bicycle <br />accessway easement is the required minimum 10-feet wide, it is less than 30-feet north of the common <br />boundary between the subject lots, and the easement runs between and connects to the existing public <br />sidewalks on Alder Street to the east and Hilyard Street to the west. This condition is met. <br /> <br />2. Prior to final plat approval, the applicant shall submit an updated site plan that depicts <br />the area and construction design details of a “Pedestrian and Bicycle Accessway” of at <br />least 10 feet in width, designed to meet the specifications for a public accessway in the <br />City's adopted Design Standards and Guidelines for Eugene Streets, Sidewalk, <br />Bikeways and Accessways except that drainage can occur within the accessway <br />easement area as long as the 10-foot accessway is ADA compliant and lighting can be <br />providing on the building(s) to satisfy the lighting requirements or if a discretionary path is <br />preferred by the Applicant, as approved by the PW Director, and located within the public <br />access easement shown on the final plat. Construction of the public accessway shall <br />occur as part of the first parcel to be developed and shall be completed prior to issuance <br />of final Certificate of Occupancy. The pedestrian and bicycle accessway must be signed <br />in a way that makes it clear that it is publicly accessible to pedestrians and bicyclists, at <br />each terminus where the Pedestrian and Bicycle Accessway intersects with the <br />sidewalks on Alder Street and Hilyard Street. The public accessway may be closed or <br />partially used by the property owner for construction activities as reasonably required <br />during the construction of the second parcel, and maintenance or remodel of any <br />permitted buildings on the subject property. <br /> <br />The attached updated Site Plan shows the public “Pedestrian and Bicycle Accessway” of at least 10 feet <br />in width with a design detail consistent with the specifications in the City's current adopted Design <br />Standards and Guidelines for Eugene Streets, Sidewalk, Bikeways and Accessways and this condition of <br />approval. As allowed in this condition of approval, the drainage is proposed to occur within the <br />accessway easement area, the 10-foot accessway will be ADA compliant, and lighting will be provided on <br />the building(s) to satisfy the lighting requirements. Additionally, the public pedestrian and bicycle <br />accessway is shown signed in a way that makes it clear that it is publicly accessible to pedestrians and <br />bicyclists, at each terminus where the public pedestrian and bicycle accessway intersects with the <br />sidewalks on Alder Street and Hilyard Street. Additional design details will be provided at the time of <br />PEPI (privately engineered, public improvement) permit submittal.
