City of Eugene <br />Final Plat Partition <br />February 2, 2026 <br />Page 5 of 10 <br /> <br /> <br />(3) Public improvements as required by this land use code or as a condition of tentative <br />plan approval are completed, or: <br />(a) A performance bond or suitable substitute as agreed upon by the city and <br />applicant has been filed with the city finance officer in an amount sufficient to <br />assure the completion of all required public improvements; or <br />(b) A petition for public improvements and for the assessment of the real property for <br />the improvements has been signed by the property owner seeking the partition <br />and the petition has been accepted by the city engineer. <br /> <br />Findings: The Tentative Partition Plan conditions of approval require two public improvements and an <br />irrevocable petition, as follows: <br />• A minimum 10-foot-wide public pedestrian and bicycle accessway easement located generally <br />along the shared property boundary of the proposed lots as described in Conditions 1 and 2, and <br />• Widening the public sidewalk to a minimum of 10 feet along the East 13th Avenue property <br />frontage (Condition 3). <br />• Irrevocable Petition for public improvements in Alder Street to include street trees (Condition 4), <br />which does not require a performance bond. <br />Prior to recording the Final Plat, the Applicant understands that a required performance bond as part of <br />the public improvement(s), if applicable, will be filed with the City Finance officer in an amount sufficient <br />to assure the completion of these public improvements described above. This criterion is met. <br /> <br />(4) Public assessments, liens, and fees with respect to the partition have been paid, or: <br />(a) A segregation of assessments and liens has been applied for and granted by the <br />city, or <br />(b) An adequate guarantee in a form acceptable to the city manager has been <br />provided assuring the liens, assessments and fees will be paid prior to recording <br />the final plat. <br /> <br />Findings: There are no known assessments, liens, or fees associated with the partition. This criterion is <br />not applicable. <br /> <br />(5) All conditions of tentative partition approval have been met and the final plat <br />substantially conforms to the provisions of the approved tentative partition. <br /> <br />Findings: The conditions of Tentative Partition (City File No. PT 25-14) approval are listed below in <br />italicized text, with the Applicant’s findings following each condition in normal text. <br /> <br />1. Prior to final plat approval, the final plat shall depict the dedication of an easement for public <br />pedestrian and bicycle accessway that is not less than 10 feet wide. The public access <br />easement shall be located within 30-feet North and South of the common boundary between <br />the two proposed parcels. The public access easement must be located fully within this 60- <br />foot wide strip and shall run between and connect the existing public sidewalks located on <br />Alder Street and Hilyard Street.
