City of Eugene <br />Final Plat Partition <br />February 2, 2026 <br />Page 7 of 10 <br /> <br /> <br />As noted on the attached updated Site Plan, the public pedestrian and bicycle accessway will occur as <br />part of the first parcel to be developed and shall be completed prior to issuance of final Certificate of <br />Occupancy for this first parcel. <br /> <br />Per the condition, in lieu of designing the proposed public “Pedestrian and Bicycle Accessway” in <br />accordance with the City’s currently adopted Design Standards and Guidelines for Eugene Streets, <br />Sidewalks, Bikeways, and Accessways with the noted exceptions in this condition of approval, the <br />Applicant may elect to pursue a discretionary design alternative, subject to approval by the Public Works <br />Director. Any discretionary design shall be a minimum of 10 feet in width, located within the public <br />accessway easement shown on the attached Land Partition Plat plan, and consistent with Condition 1 <br />and Final Plat Partition approval. <br /> <br />The updated Site Plan is provided for reference purposes only to demonstrate that the conditions of <br />approval can be met as required for the Final Plat Partition application. Per this condition of approval and <br />outlined above, the conditions of approval allow for design flexibility, so the required public pedestrian <br />and bicycle accessway and signage location and design may be modified at the time of the required <br />PEPI permit process as long as in compliance with the applicable Tentative Partition conditions of <br />approval and Final Plat Partition decision. This condition is met. <br /> <br />3. Prior to final plat approval, the applicant shall submit an updated site plan the depicts the <br />construction of a 10-foot-wide curbside sidewalk within the East 13th Avenue right-of-way to <br />a minimum of 10 feet in width, incorporating tree wells instead of landscaped planter strips. <br />The updated site plan shall include the following note, “Prior to issuance of the Certificate of <br />Occupancy for Parcel 1, a 10-foot-wide curbside sidewalk within the East 13th Avenue right- <br />of-way, incorporating tree wells instead of landscaped planter strips”. <br /> <br />In follow-up coordination with City planning staff after the issuance of the Tentative Partition decision, <br />staff explained that a minimum 10-foot-wide curbside sidewalk with tree wells is clearly required by code <br />and the City’s currently adopted Design Standards and Guidelines for Eugene Streets, Sidewalks, <br />Bikeways, and Accessways, as provided in the findings for the decision by Eugene Code. While the <br />requirement is clear, City planning, public works and urban forestry staff recognize that the curbside <br />sidewalk may not represent the best-case scenario design outcome. For instance, as reflected in the <br />draft street design guide (not yet adopted), a planter strip adjacent to the street provides better <br />separation for pedestrians and long-term health for street trees (as opposed to tree wells or pits). <br /> <br />In summary after coordination with City planning staff, there are two ways to meet the condition of <br />approval: <br />• Option 1: Provide a minimum 10-foot-wide curbside sidewalk with tree wells. <br />• Option 2: The Applicant may propose an alternative design for review and approval as part of the <br />Final Plat Partition application process to provide a public sidewalk beginning at the property line, <br />with a minimum width adequate to accommodate higher pedestrian volumes in the commercially <br />zoned West University area. A curbside planter strip shall be provided, with its width determined <br />by the remaining space between the public sidewalk and the curb.
