City of Eugene <br />Final Plat Partition <br />February 2, 2026 <br />Page 8 of 10 <br /> <br /> <br /> <br />Consistent with this coordination with City staff, the Applicant proposes an alternate design to provide a <br />9-foot-wide public sidewalk with about a 6-foot curbside planter strip (planter strip size to be based on the <br />remaining space between the public sidewalk and the curb) in lieu of the curbside sidewalks and tree <br />wells adjacent to Parcel 1 on East 13th Avenue. The City staff acknowledges that in either option some <br />or all of the existing street trees may need to be removed and replaced, and ultimately the replanted <br />trees will have a better long-term outcome within a planter strip instead of tree wells. <br /> <br />The attached updated Site Plan illustrates the required East 13th Avenue public sidewalk with a <br />proposed 9-foot width beginning at the property line and an approximately 6-foot-wide planter strip <br />provided in the remaining space between the sidewalk and the street curb within the East 13th Avenue <br />right-of-way. The updated Site Plan is provided for reference purposes only to demonstrate that the <br />conditions of approval can be met as required for the Final Plat Partition application. <br /> <br />As explained by City staff in follow-up communication and outlined above, the conditions of approval <br />allow for design flexibility; therefore, the exact location and design of the required public sidewalk may be <br />modified during the PEPI permit or building permit process, as applicable, provided the final design <br />complies with the Final Plat Partition decision. <br /> <br />The updated Site Plan also includes the following note: <br />“Prior to issuance of the Certificate of Occupancy for Parcel 1, a public sidewalk within the East <br />13th Avenue right-of-way will be constructed, incorporating tree wells or landscaped planter <br />strip(s) as approved as part of the Final Plat Partition decision.” <br />This note shall be revised on the updated Site Plan prior to Final Plat Partition application approval to <br />more accurately reflect the Final Plat decision. The revised note on the final updated Site Plan will be <br />included on the PEPI or building permit plans, as applicable. The Applicant requests that the Final Plat <br />decision allow the Applicant the option to proceed with the proposed alternative design or this condition <br />as written. <br /> <br />With the findings provided above, this condition is met. <br /> <br />4. The applicant shall submit an Irrevocable Petition for public improvements in Alder Street <br />to include street trees. <br /> <br />A draft of the Irrevocable Petition for the required street trees in the Alder Street right-of-way is <br />attached for review. Signatures and recording will follow coordination with City staff to ensure <br />accuracy. This condition is met. <br /> <br />5. The applicant shall submit a geological and geotechnical analysis that complies with EC <br />9.6710(6). <br /> <br />A geological and geotechnical analysis is attached. This condition is met.
