Prior to final plat approval, the applicant shall remove the existing structure shown on the site <br />plan. Alternatively, prior to final plat approval, the applicant shall execute a deed restriction <br />that holds Parcel 1 and 2 under common ownership as a single development site until such a <br />time that the structure is removed. <br /> <br />In follow-up coordination with City planning staff after the issuance of the Tentative Partition decision, <br />City staff explained that there are two ways to satisfy the condition of approval: <br /> <br />• Option 1: Only the portion of the existing structure (hospital) located on the first parcel to be <br />developed is required to be removed prior to Final Plat approval, provided that the remaining <br />portion of the structure continues to comply with applicable building code and land use <br />requirements. <br />o In other words, the portion of the existing structure located on the second parcel to be <br />developed is not required to be demolished- prior to Final Plat approval. <br />• Option 2: The Applicant may execute a deed restriction requiring Parcels 1 and 2 to remain <br />under common ownership or common control as a single development site until such time as <br />the structure is removed. City staff confirmed that the Eugene Code definition of “development <br />site” is the controlling standard in this condition and that this definition includes property under <br />common control. <br /> <br />“Development Site. A tract of land under common ownership or control, either undivided <br />or consisting of two or more contiguous lots of record. For the purpose of land use <br />applications, development site shall also include property under common ownership or <br />control that is bisected by a street or alley.” <br /> <br />Demolition of at least the existing structure on the first parcel to be developed (proposed southern Parcel <br />1) will be removed prior to Final Plat approval and consistent with the applicable building code and land <br />use requirements, and the City demolition permit approval issued on January 30, 2026. Alternatively, the <br />Applicant will execute a deed restriction requiring Parcels 1 and 2 to remain under common ownership or <br />common control as a single development site until such time as at least the existing structure on the first <br />parcel to be developed is removed. This condition is met. <br /> <br />Based on the above findings and attached documents, all conditions of the Tentative Partition Plan <br />approval have been or can be met. The proposed Final Plat Partition application substantially conforms <br />to the provisions of the approved Tentative Partition Plan. This criterion is met. <br /> <br />
