<br />Nemke – Property Line Adjustment Page 6 of 8 <br /> February 2, 2026 <br /> <br /> <br /> <br />(2) A property line adjustment application may not be utilized to effect the <br />reconfiguration of lots or parcels which must be approved through the partition or <br />subdivision procedure. <br />No additional lots are being created, no property line adjustments have been previously <br />requested or approved, the resulting boundary change is less than 200% area, and no <br />substandard public facilities or services are requested or required. Therefore, this <br />criterion is adequately addressed. <br /> <br />(3) A property line adjustment application may not be utilized to create flag lots. <br />No flag lots are being created by this Property Line Adjustment application. Therefore, <br />this criterion is not applicable. <br /> <br />EC 9.8415 – Property Line Adjustment - Approval Criteria <br /> <br />The planning director shall approve, approve with conditions, or deny the property line <br />adjustment application. Approval or approval with conditions shall be based on <br />compliance with the following criteria: <br />(1) Any buildings to be retained on the properties comply with the minimum front <br />and interior yard setbacks as defined in this land use code. <br />The site received Final Plat approval as part of City File #M 99 -29 on June 5, 2000. <br />Therefore, the flag lot setback standards listed at EC 9.2775(5)(b) are not applicable as <br />this approval was prior to December 25, 2002. <br /> <br />That said, and as shown on the attached Proposed Property Line Adjustment Map, the <br />minimum side yard setback of 5 feet at EC Table 9.2750 is exceed along all portions of <br />the existing Accessory Structure adjacent to the proposed boundary. <br /> <br />Additionally, and due to the sloping nature of the site, the Accessory Structure Slope <br />Setback requirement for areas above 8 ft from finished grade is also met as the <br />structure’s southwest facing eves and sloping roof pitch are approximately 5 feet from <br />grade, located approximately 7 feet from the newly proposed boundary with an <br />approximate roof pitch of 4:12, resulting in all portions of the structure set below the <br />slope setback area shown in the figure below . <br /> <br /> <br /> <br />Therefore, we assert that this criterion is adequately addressed, and the proposed <br />Property Line Adjustment meets the minimum standards at (EC) Section 9.8415(1).
