<br />Nemke – Property Line Adjustment Page 7 of 8 <br /> February 2, 2026 <br /> <br /> <br /> <br />(2) The final configuration of property lines shall not reduce an existing lot below <br />the minimum lot standards established in this land use code or otherwise violate <br />standards of this land use code, building codes, fire codes, and Chapter 7. <br />EC Table 9.2750 requires a minimum lot size of 4,500 square feet for Residential Flag <br />Lots. As noted above, TL 301 will be approximately 1 3,004 square feet post adjustment <br />and TL 302 will be 15,658 square feet post adjustment in compliance with this standard. <br /> <br />TL 301 will be reduced to an average width of approximately 65 feet in compliance with <br />the minimum width required at 50 feet. TL 302 will be reduced to an average width of <br />approximately 90 feet in compliance with the minimum width required at 50 feet. <br /> <br />Lot frontage for TL 301 will be reduced to approximately 129 feet . Lot frontage for TL <br />302 Flag Lot will be expanded to approximately 31 feet. <br /> <br />Therefore, this criterion is met. <br /> <br />(3) The final configuration of property lines shall not violate any previous <br />requirements or conditions of approval imposed with a prior applicable land use <br />decision. <br />There are no know conditions of approval or other requirements imposed on either <br />property. Therefore, this criterion is not applicable. <br /> <br />(4) Public assessments, liens, and fees with respect to the property line <br />adjustment have been paid, or: <br />(a) A segregation of assessments and liens has been applied for and <br />granted by the city; or <br />(b) An adequate guarantee in a form acceptable to the city manager has <br />been provided assuring the liens, assessments and fees will be paid prior <br />to recording the property line adjustment. <br />Approval of a property line adjustment does not relieve the applicant from <br />complying with all applicable codes or statutory requirements. <br />No liens exist for either property. The application fee has been submitted in <br />compliance with this standard. <br /> <br />Neither parcel is located with the /WR or /WQ Overlay Zones, nor within the R-1 zone in <br />the city-recognized boundaries of Amazon Neighbors, Fairmount Neighbors and South <br />University Neighborhood Association . As such, Sections (5) and (6) of this chapter are <br />not applicable. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
