Conditional Use Permit Approval Criteria – Supporting Facts and Findings <br /> <br />A. Conditional Use Permit criteria and standards <br /> <br />This section is organized by documenting the applicable approval criteria per (EC) 9.8075 in bold italics, <br />followed by proposed findings in normal text. <br /> <br />EC 9.8075 Purpose of Conditional Use Permits. <br />Certain types of uses require special consideration before being permitted in particular <br />zones. The reasons for requiring special consideration include, for example, the size of the <br />area required for the full development of those uses, the nature of traffic problems incidental <br />to operation of those uses, the effect those uses might have on adjoining land uses, <br />potential environmental impacts, and their effect on the growth and development of the <br />community as a whole. Uses permitted only with a conditional use permit may also possess <br />unique or special characteristics that make it unacceptable to permit them in particular <br />zones without conditions. In zones where a use may be conditionally permitted, the location <br />and operation of the use is subject to conditional use permit review and approval under a <br />Type III application procedure. One purpose for the review is to determine if the <br />characteristics of the use can be made reasonably compatible with the type of uses <br />permitted outright in surrounding areas. Another purpose is to provide reasonable and <br />necessary conditions so the basic purposes of this land use code are served. <br /> <br />EC 9.8080 Applicability. <br />Conditional use permits apply to the initiation or expansion of a use listed as being subject <br />to the conditional use permit review process in this land use code. When a conditional use <br />permit is required, no development permit shall be issued by the city prior to approval of the <br />conditional use permit. <br /> <br />Findings: The City confirmed in the required Pre-application conference that the proposed satellite <br />Emergency Department facility is likely considered a Hospital use, despite the discrete differences <br />between the proposed use and a conventional hospital. Per EC Table 9.2160 Commercial Zone Land <br />Use and Permit Requirements, a “Hospital” use requires approval of a CUP prior to the submittal and <br />issuance of a development permit in the C-2 zone. Therefore, the Applicant is submitting a CUP <br />application for the proposed use. <br /> <br />EC 9.8085 Conditional Use Permit Application Requirements. <br />(1) Conditional use applications shall be processed in accordance with the application <br />procedures contained in EC 9.7000 through 9.7885, Application Procedures. <br />
