<br />The development site is zoned S-SW, Whiteaker Special Area Zone with a Site Review Overlay. <br />This is a mixed-use zone that allows a variety of residen$al uses including mul$ple-unit <br />development as a permi/ed use subject to Site Review and other applicable standards. <br />Therefore, this condi$on is met. <br /> <br />(c) The residen"al development is for densi"es not less than those required under sec"on <br />55(3)(a)(C) of this 2024 Act; <br /> <br /> Sec"on 55(3)(a)(C)(ii): The development will be built at net residen"al densi"es not <br />less than ten units per net residen"al acre if sited in a city with a popula"on of 30,000 <br />or greater; <br /> <br />The development site is approximately 0.55 acres in size. The proposed development includes a <br />total of 75 dwelling units, which exceeds 10 units per acre. Therefore, this condi$on is met. <br /> <br />(d) The development is within an urban growth boundary, not including lands that have <br />not been annexed by a city; <br /> <br />The subject property is located within the City limits and within Eugene’s Urban Growth <br />Boundary; therefore, this condi$on is met. <br /> <br />(e) The development is of net new housing units in new construc"on projects, including <br />(A) Single-family or mul"family; <br />(B) Mixed-use residen"al where at least 75 percent of the developed floor area will <br />be used for residen"al uses; <br />(C) Manufactured dwelling parks; <br />(D) Accessory dwelling units; or <br />(E) Middle housing as defined in ORS 197A.420; <br /> <br />The proposed development is for a new mul$ple-unit (previously called “mul$family”) <br />construc$on project with new housing units. Therefore, this condi$on is met. <br /> <br />(f) The applica"on requests not more than 10 dis"nct adjustments to development <br />standards as provided in this sec"on. <br /> <br />The applica$on requests five dis$nct adjustments at Sec$ons 38(4)(g)(A), (B) and (C), as well as <br />(5)(b) and (5)(g). Each of these is individually addressed below as they relate to EC development <br />standards and how the proposal complies with the statutory requirements for approval. <br /> <br /> Adjustment #1: Bicycle Parking <br />Sec"on 38(4)(g)(A): Requirements for bicycle parking that establish: <br />i. The minimum number of bicycle parking spaces, for a reduc"on not greater than <br />an adjustment that will allow for one-half space per residen"al unit; <br /> <br />The proposal requests an adjustment under this provision to allow the minimum bicycle parking <br />standard at EC 9.6105(5) to be reduced from 1 space per dwelling unit to no less than one-half
