use according to the S-SW Zone, but in addi$on to Site Review approval (due the /SR Overlay <br />Zone) it is also subject to applicable mul$ple-family development standards at EC 9.5500. <br /> <br />In summary, the applicant requests that the applicable development standards according to the <br />S-SW Zone be adjusted to allow for up to 9 feet of addi$onal height beyond the 45-foot <br />maximum, which in turn will allow for addi$onal residen$al density beyond the normal <br />maximum to make the 75-unit project feasible. Addi$onal adjustments to mul$ple-unit <br />development standards are also requested for window coverage and building façade <br />ar$cula$on, as well as bicycle parking standards which are all addressed in more detail below. <br /> <br />This applica$on for SB 1537 Adjustments also includes conceptual site plans and building <br />eleva$ons as requested on the applica$on form, which are provided for illustra$ve purposes at <br />this stage to help show the conceptual layout and preliminary building design as it relates to the <br />standards requested for adjustment. <br /> <br />Compliance with Statutory Requirements and Related Eugene Code Development Standards: <br />The applicant’s request for mandatory adjustments meets the statutory requirements for <br />approval under the provisions of Oregon Senate Bill (SB) 1537 (Sec$on 38, Mandatory <br />Adjustments to Housing Development Standards). The proposed adjustments are “ministerial” <br />in nature, being subject clear and objec$ve review and therefore should qualify for processing <br />under the City’s Type I applica$on procedures at EC 9.7100 through EC 9.7115. <br /> <br />In this case, the applicant proposes several adjustments to applicable EC development <br />standards rela$ng to maximum building height, maximum residen$al density, window coverage, <br />building façade ar$cula$on and bicycle parking. The findings below demonstrate how the <br />proposal meets applicable requirements under SB 1537 for each dis$nct adjustment to related <br />EC development standards. As demonstrated below, all the proposed adjustments are jus$fied <br />and should therefore be granted approval. <br /> <br />In accordance with SB 1537 Sec"on 38(2), a local government shall grant a request for an <br />adjustment to develop housing if specific condi$ons are met. The condi$ons below (in bold), <br />include findings addressing compliance. <br /> <br />(a) The applica"on is for a building permit or a quasi-judicial, limited or ministerial land <br />use decision; <br /> <br />As noted above, the proposal is for a 75-unit affordable housing project as a permi/ed use <br />subject to Site Review approval, and subsequent building permits. The applicant is seeking <br />adjustments under SB 1537, and this applica$on is being processed as a ministerial land use <br />decision under EC Type I applica$on procedures. As explained in the introductory comments for <br />this applica$on, the requested adjustments are also a necessary predicate for the applicant to <br />gain enough certainty about the project and proposed design, before applying for affordable <br />housing funding, future Site Review approval and then building permits. Therefore, this <br />condi$on is met. <br /> <br />(b) The development is on lands zoned to allow for residen"al uses, including mixed-use <br />residen"al;
