The JAM will be recorded concurrent with and cross- <br />referenced on the final plat. <br />This item is still in process with the attorney who is drafting tis document. <br /> <br />6. Provisions for a public emergency access easement within the private street may be included in the proposed <br />JAM which creates the private street, or alternatively, may be dedicated as a Public Emergency Access <br />Easement on a standard city form. <br />Provisions for public emergency access within the private street have been included in the JAM. <br /> <br />7. Prior to final plat approval, the applicant shall dedicate a 14-foot Public Utility Easement or Public Wastewater <br />Easement that will encumber the proposed wastewater system. The required easement shall also be shown on <br />the revised final PUD Plans. <br />The entire right of way for proposed Randy Lane, Proposed Tambour Court and Proposed Tambour Lane will <br />be dedicated as a PUE that will encompass the proposed wastewater system. <br /> <br />8. The final PUD site plans shall include the following note: “No building, structure, tree or other obstruction shall <br />be placed or located on or in a Public Utility Easement, consistent with EC 9.6500(3)”. <br />See revised Site Plan for note. <br /> <br />9. The final PUD site plans shall include the following note: “Compliance with public improvement requirements <br />shall be demonstrated in accordance with EC 9.6505 as part of the permitting process for development within <br />the PUD including Privately Engineered Public Improvement (PEPI) Permits, Site Development Permits and <br />Building Permits.” <br />See revised Site Plan for note. <br /> <br />10. The final PUD site plans shall include the following note: “A Privately Engineered Public Improvement (PEPI) <br />permit shall be issued for the construction of public improvements prior to development.” <br />See revised Site Plan for note. <br /> <br />11. Prior to final plat approval, the applicant shall provide documentation that EWEB has received a financial <br />guarantee, ensuring water will be provided to each lot in the plat. <br />Acknowledged and agreed. <br /> <br />12. Prior to final PUD approval, the applicant shall submit an updated site plan that depicts wastewater service to <br />Lot 38. Alternatively, the applicant may combine Lots 37 and 38 to demonstrate compliance with the <br />requirement for wastewater service. <br />Lots 37 and 38 have been combined into Lot 37. Lot 37 is served by private wastewater as depicted on the <br />Site Plan. <br /> <br />13. The applicant shall submit an Irrevocable Petition for public improvements in Hawkins Lane to include <br />sidewalks <br />See attached Irrevocable Petition for public improvements in Hawkins Lane. <br /> <br />14. The applicant shall submit an Irrevocable Petition for public improvements and Randy Lane (existing portion <br />between Hawkins Lane and Black Tail Drive) to include setback sidewalks and street trees. <br />See attached Irrevocable Petition for public improvements in Randy Lane. <br /> <br />15. The proposed Joint Access Easements, which are subject to City review and approval prior to recording with <br />the final plat, shall be cross-referenced on the plat and be accompanied by a maintenance agreement for each <br />share driveway, which addresses the rights and responsibilities of each parcel relative to each shared <br />driveway. <br />See attached maintenance agreement for each Joint Access Easement. <br />· Variable Width Private Utility and Access Easement - Lots 1,2,6,7,11 and 12. <br />· Variable Width Private Utility and Access Easement - Lots 4,5,9 and 10. <br />· 14’ Wide Private Utility and Access Easement - Lots 9,10,13 and 14. <br />· 10’ Wide Private Utility Easement – Lots 16,17 and 19.
