Currently, in accordance with Ordinance No. 20351, which adopted the Goal 5 measures and <br />inventory, E75 B-3 has no protection through the City's Goal 5 regulations. The applicant argues <br />that this portion of the Goodpasture Island Slough should be afforded protection under Goal 5. <br />The applicant has also requested the inclusion of potential riparian or wetland resources <br />located on Tax Lot 17-04-13-14 / 00033 (herein referred to as "Tax Lot 33"). Tax Lot 33 is a large <br />tax lot located directly southwest of the Beltline and southeast of the Willamette River. Tax Lot <br />33 is indicated by a "star" in Figure 1. No Goal 5 resource is directly associated with the area <br />subject to the request. Rather, Tax Lot 33 is near resources E75 B-1 (a riparian resource) and <br />WKZ-513 (a wetland resource) which exist to the southeast of Tax Lot 33. The applicant asserts <br />that the entirety of the subject property should be identified as a non -developable, protected <br />riparian/wetland resource, given the site's vegetation and ecology. As such, it can be assumed <br />that the applicant's request is to amend the mapping of resources E75 B-1 or WKZ 5B to <br />encompass Tax Lot 33. <br />It is noted that all areas requested for a resource site mapping correction are currently within <br />the /WR Water Resources Conservation Overlay Zone. The application of the /WR Overlay Zone <br />is due to the location of protected riparian resources on or near the subject properties. For <br />example, Tax Lot 33 has the /WR Overlay Zone because of its proximity to the Willamette River. <br />The applicant also requested numerous other answers and responses to concerns and topics <br />that are outside the scope of an application for a /WR Overlay Zone Map Correction, including <br />but not limited to: property ownership, code compliance resolution, fences, pathways, and <br />Planned Unit Development history. The following evaluation will be limited to a scope that <br />encompasses those issues directly relevant to the approval criteria for the /WR Overlay Zone <br />Map Correction, as found at Eugene Code (EC) 9.4960(3)(b). <br />Additional details of the proposal are included in the applicant's written statement and <br />supporting documentation, all of which are included as part of the public record and <br />located in the application file for reference. <br />Public Notice and Referrals <br />Public notice of this Overlay Zone Map Correction application was provided in accordance with <br />Eugene Code (EC) requirements. The Planning Division mailed notice of the applications on <br />August 15, 2025, to all those specified at EC 9.7210. <br />The Planning Division received 58 pieces of public testimony in response to the public notice, all <br />of which is included in the record for reference. A summary of the public comments is provided <br />below. It is noted that much of the testimony provided information or responses that are <br />outside the scope of a /WR Overlay Zone Map Correction application. Many of the individuals <br />who provided testimony in opposition to the request stated that approval of the requested <br />changes would have impacts on their properties, such as nuisances and other negative <br />externalities. Testimony in support generally focused on the anticipated positive ecological <br />benefits of adding additional resource area for Goal 5 protection measures.
