by Mike Reeder, representing the impacted property owner, requested that the Planning <br />Director "reject" the application, citing procedural error in accepting an application without the <br />owner's signature. <br />To the extent that the City can consider the concerns expressed in public comments, the <br />comments must be considered under the approval criteria provided by the Eugene Code. As <br />such, relevant comments are discussed in the following evaluation of the applicant's request, at <br />the level of specificity warranted by the approval criteria at EC 9.4960(3)(b). <br />The Planning Division also provided information concerning the application to other <br />appropriate City departments, public agencies, and service providers. Any referral comments <br />received by the Planning Division on this application are included in the application file for <br />reference and addressed in the context of the applicable approval criteria and standards in the <br />following evaluation. Additional Informational Items are also attached at the end of this <br />decision. <br />EVALUATION <br />The following evaluation addresses details of the proposal in the context of compliance with <br />the applicable approval criteria and related standards. The Eugene Code provides for review of <br />alleged errors in the application of the /WR Water Resources Conservation Overlay Zone and in <br />the mapping of Goal 5 resource sites on the Goal 5 Water Resources Conservation Plan Map. <br />Requests based solely on aerial photography or Geographic Information System Data are <br />subject to Type I Land Use Application Procedures, and requests based on additional evidence <br />are subject to Type II Land Use Application Procedures. In this case, the applicant has applied <br />for review based on additional evidence, pursuant to EC 9.4960(3). <br />As the application is subject to review under the approval criteria at EC 9.4960(3), this request <br />is subject to the Type II Land Use Application procedures, which are primarily addressed at <br />Eugene Code (EC) 9.7200-9.7230. In accordance with Type II Land Use Application Procedures, <br />the Planning Director shall approve or deny the application based on compliance with the <br />criteria at EC 9.4960(3)(b). Those criteria are provided below (in bolded text), including findings <br />addressing compliance with each. <br />EC 9.4960(3)(b): Approval Criteria. <br />(1) For allegations of error on the Goal 5 Water Resources Conservation Plan Map: at the <br />time the city adopted the Goal 5 Water Resources Conservation Plan Map, that Map <br />showed an incorrect location of the identified Goal 5 Water Resource Site. <br />(2) For allegations of error on the Eugene Overlay Zone Map: at the time the city applied <br />the /WR Water Resources Conservation Overlay Zone to the subject lot(s), the city <br />was incorrect in its determination that the lot(s) contained a Goal 5 Water Resource <br />Site or a /WR Water Resources Conservation Area. <br />September 2025 Findings & Decision of the Planning Director Page 4 of 6 <br />Valley River Village PUD (OC2 25-01) <br />
