PROPERTY LINE ADJUSTMENT <br />KWOK – ROSE LANE <br />3 | P a g e <br /> <br /> <br />EC 9.8405 – Applicability of Property Line Adjustment Applications. <br />(1) A property line adjustment application is applicable to changes to the property lines of adjoining properties when <br />all of the following exist: <br /> (a) A property line proposed for adjustment will not result in an increase in the number of parcels or lots. <br />Response: The proposed property line adjustment will not increase the number of lots; it only adjusts the boundary line <br />between Tax Lots 4000 & 4001. The proposal is in compliance with this criterion. <br /> <br /> (b) A property line proposed for adjustment will not create more than 2 property line adjustments to any of <br /> the boundaries of an individual lot or parcel within a calendar year. This subsection does not apply to <br /> proposed property line adjustments undertaken by or on behalf of a governmental entity that affect the <br /> ability to preserve, manage, or expand park, open space, or natural resource areas. <br /> <br />Response: The proposed property line adjustment will not create more than two property line adjustments to any of the <br />boundaries of the subject properties within one calendar year. The proposal is in compliance with this criterion. <br /> <br />(c) The adjustment will result in less than a 200% change in the size of the lot or parcel. This subsection <br /> does not apply to proposed property line adjustments undertaken by or on behalf of a governmental <br /> entity that affect the ability to preserve, manage, or expand park, open space, or natural resource areas. <br /> <br />Response: The proposed adjustment results in less than a 200% change in the size of either lot. To find the percentage <br />change for each lot, the following formula is used: (X2-X1) / X1 * 100. See below for specific calculations for this proposal: <br /> <br />Property 1 (TL 4000): 9016 – 5166 = 3850; 3850/ 5166 = 0.745; 0.745 x 100 = 75% increase (complies) <br />Property 2 (TL 4001): 9016 – 3850 = 5166; 5166/ 3850 = 1.341; 1.341 x 100 = 134% increase (complies) <br /> <br />The property line adjustment will result in a 75% increase in area to Property 1 and a 134% increase in area to Property 2. <br />In sum, in compliance with this criterion, the adjustment will result in less than a 200% change in the area of either property. <br /> <br />(2) A property line adjustment application may not be utilized to effect the reconfiguration of lots or parcels which <br />must be approved through the partition or subdivision procedure. <br /> <br />Response: No reconfiguration of parcels that must be approved through a partition or subdivision procedure is proposed. The <br />proposed property line adjustment applies only to the boundary line between the two parcels and does not reconfigure the <br />arrangement of either parcel or adjust any exterior boundary lines. The proposal complies with this criterion. <br /> <br />(3) A property line adjustment application may not be utilized to create flag lots. <br /> <br />Response: No flag lots will be created with this proposal.
