PROPERTY LINE ADJUSTMENT <br />KWOK – ROSE LANE <br />2 | P a g e <br /> <br /> <br />BACKGROUND <br /> <br />This property line adjustment application pertains to Assessor’s Map number 17-03-33-34, Tax Lots 4000 and 4001 also <br />known as 2245 and 2255 Rose Lane, respectively. Both tax lots (“subject properties”) are legally established lots of record <br />under common ownership. The subject properties are zoned R-1, located in the Fairmount neighborhood district within the city <br />of Eugene city limits and maintain a Low-Density Residential Metro Plan Designation. <br /> <br />The subject properties are legal lots of record that were lawfully established as described in the following 2008 Legal Lot <br />Verification letter (attached) excerpt from City staff: <br /> <br />Based on City staff research of available information, staff has determined that current Tax Lot 4000 <br />contains two legal lots. The first legal lot is a remnant of Lot 11 Block 31 of the Amended Plat of Fairmount <br />created by the dedication of right of way. In 1932, Rose Lane was dedicated by deed on page 142 in book 173 <br />in the Lane County Deeds and Records Office. This dedication bisected Lot 11 Block 31 of the Amended Plat <br />of Fairmount creating two legal lots. The second legal lot created was by deed recorded October 2, 1933 on <br />pages 251 & 252 in book 177 in the Lane County Deeds and Records Office. <br /> <br />The 1932 road dedication of Rose Lane created one legal lot that was 1,177 sq ft (“Parcel B”), while the second legal lot <br />(“Parcel A”) was 7,832 sq ft. In 2008, the City of Eugene approved a property line adjustment (LA08-30) to the boundary line <br />between the two legal lots to effect more appropriate conformity with R-1 zone. This land use action successfully increased <br />Parcel B of LA08-30 to 3,530 sq ft, leaving Parcel A of LA08-30 at 5,479 sq ft. <br /> <br />The Fairmount Neighbors area carries a code restriction which limits a property line adjustment to five (5) feet per adjustment, <br />not to exceed two adjustments in one calendar year. For this reason, it has taken multiple adjustments to bring the subject <br />properties closer to conformance with zone lot standards. In 2023, the subject properties underwent another property line <br />adjustment (LA23-15), approved on May 9, 2024, effectively continuing to increase conformity with R-1 lot standards. Later in <br />2024, the subject properties underwent another property line adjustment (LA 24-9), approved September 9, 2024, which <br />effectively brought Parcel 1 to 5,166 square feet and Parcel 2 to 3,850 square feet. This 2025 proposal intends to accomplish <br />the same goal as the previous property line adjustments however choosing to do so by eliminating the common boundary line <br />with this property line adjustment, and once approved, performing a middle housing land division to create the desired two <br />parcels of generally 4,500 square feet each. The property owner is aware that no further land development may occur on the <br />future middle housing lots once the entire process is complete. <br /> <br />This written narrative serves to demonstrate the proposed property line adjustment’s compliance with the criteria, <br />requirements, and standards for property line adjustments contained within applicable sections of the Eugene Code (EC) <br />including, EC 9.8405 – Applicability of Property Line Adjustment Applications and EC 9.8415 – Property Line Adjustment – <br />Approval Criteria.
