Tentative PLA <br />Written Statement <br />March 19, 2025 <br />Branch Engineering, Inc.Page 2 of 4 <br />(2)A property line adjustment application may not be utilized to affect the <br />reconfiguration of lots or parcels which must be approved through the <br />partition or subdivision procedure. <br />No lots or Parcels are being changed such that a partition or subdivision is <br />necessary. <br />(3)A property line adjustment application may not be utilized to create flag <br />lots. <br />No flag lots are being created by this application. <br />9.8410 Property Line Adjustment Application Requirements. In addition to the <br />provisions in EC 9.7010 Application Filing, the following specific requirements <br />shall apply to property line adjustment applications. <br />(1)Except for parallel property line adjustments to platted lots, when the <br />adjusted property line is a distance of even width along the common <br />boundary, all applications shall be prepared by an Oregon licensed Land <br />Surveyor. <br />The application is prepared by Daniel Adam Nelson, PLS. <br />(2)Applications shall be signed by at least one of the owners of each parcel <br />involved, and shall include a preliminary title report issued within one year <br />of the date the application is submitted, for each parcel. <br />The owners of the property have signed the application and provided a title <br />report. <br />9.8415 Property Line Adjustment Approval Criteria. The planning director shall <br />approve, approve with conditions, or deny the property line adjustment <br />application. Approval or approval with conditions shall be based on compliance <br />with the following criteria: <br />(1)Any buildings to be retained on the properties comply with the minimum <br />front and interior yard setbacks as defined in this land use code. <br />EC 9.3155 (2) Setbacks (Building and Yard). Unless otherwise specified at EC <br />9.3180 through EC 9.3185, there are no minimum front or interior yard <br />setbacks for a building or structure. There are no buildings on either <br />property making this adjustment in compliance with setbacks. <br />(2)The final configuration of property lines shall not reduce an existing lot <br />below the minimum lot standards established in this land use code or <br />otherwise violate standards of this land use code, buildings codes, and fire <br />codes. <br />Tax Lot 1500 is zoned S-DR/CL. Tax Lot 5300 & 300 are zoned S-RP.
