Tentative PLA <br />Written Statement <br />March 19, 2025 <br />Branch Engineering, Inc.Page 3 of 4 <br />EC 9.3130 - 9.3190 Do not contain any Lot standards. <br />EC 9.3700 – 9.3730 Do not contain any Lot standards. <br />(3)The final configuration of property lines shall not violate any previous <br />requirements or conditions of approval imposed with a prior applicable <br />land use decision. <br />No previous requirements or conditions of approval conflict with the <br />proposed property line adjustment. <br />(4)Public assessments, liens, and fees with respect to the partition have been <br />paid: <br />No public assessments, liens, or fees are due at this time. <br />(5)Within the /WR Water Resources Conservation Overlay Zone or /WQ Water <br />Quality Overlay Zone, no new lot may be created if more than 33% of the <br />lot, as created would be occupied by either: <br />(a) The combined area of the /WR conservation setback and any portion of <br />the Goal 5 Water Resource Site that extends landward beyond the <br />conservation setback; or <br />(b) The /WQ Management Area. <br />Property 1 is currently 17% occupied by the Goal 5 Water Resource setback <br />and therefore will be conforming. <br />Property 2 is currently 41% occupied by the Goal 5 Water Resource setback <br />and non-conforming therefore this adjustment will maintain the non- <br />conforming status of the Property 2. <br />(6) Within the R-1 zone in the city recognized boundaries of Amazon <br />Neighbors, Fairmount Neighbors, and South University Neighborhood <br />Association, property lines may only be adjusted up to 5 feet, measured <br />perpendicularly from the current location of the property line. A property <br />line under this section may be up to 10 feet if the adjustment is necessary <br />to accommodate an encroachment that existed as of April 12, 2014. <br />The property does not reside in any of the mentioned city recognized <br />associations; the criterion does not apply.
