Project No. 21-197.1 <br />The proposed property line adjustment is located between the legal lot composed <br />of Map and Tax Lots 17-03-32-21-300 and 17-03-32-24-5300 (“Property 1”) and the legal <br />lot composed of Map and Tax Lot 17-03-32-22-1500 (“Property 2”). The site is located at <br />the intersection of E. 8th AVE. and Riverfront Parkway. <br />A Legal Lot analysis written by the client’s attorney, Michael Gelardi, is included below <br />as Exhibit C. <br />The applicant is proposing an adjustment of a portion of the common line to <br />better suit the owners’ use of their properties. <br />9.8405 Applicability of Property Line Adjustment Applications. <br />(1)A property line adjustment application is applicable to changes to the <br />property lines of adjoining properties when all of the following exist: <br />(a) A property line proposed for adjustment will not result in an increase <br />in the number of parcels or lots. <br />No new lots will be created. <br />(b) A property line proposed for adjustment will not create more than 2 <br />property line adjustments to any of the boundaries of an individual lot <br />or parcel within a calendar year. <br />No other property line adjustments have occurred on either property in <br />the last calendar year. <br />(c) The adjustment will result in less than a 200% change in the size of the <br />lot or parcel. <br />This subsection does not apply to proposed property line adjustments <br />undertaken by or on behalf of a governmental entity that affect the <br />ability to preserve, manage, or expand park, open space, or natural <br />resource areas.
