March 2025 Findings & Decision: West 20th Avenue (MHT 24-29) 4 <br />(2) Sewage <br /> <br />City sewer records indicate the existing duplex is served from the 18” Public Main within the <br />Van Buren Alley right-of-way (manhole no. 3666-5067). Sewer connection record #14179 <br />shows this duplex with one existing private service line connecting Parcel 2, which is then <br />extended underneath Parcel 2 to serve the existing structure on Parcel 1. The applicant has <br />shown a proposed 4” private connection to be constructed along the north property line of <br />Parcel 2 which will eliminate the shared single wastewater line and serve Parcel 1. The site plan <br />further details a 4- to 6-foot private wastewater easement granted by Parcel 2 for the benefit of <br />Parcel 1 with the new configuration. The standards of EC 9.8194(5) Separate Utilities for each <br />dwelling unit are discussed in detail below. <br /> <br />3) Streets and Alleys and 4) Sidewalks <br /> <br />This Middle Housing Land Division is for two existing residences and will not increase or <br />decrease the number of dwellings on the site. Therefore, there will be no significant effect on <br />the streets or alleys surrounding the development site; therefore, no changes or additions are <br />required. <br /> <br />The development site is on the corner of West 20th Avenue and Tyler Street with an alley <br />adjacent to the eastern property boundary. Both West 20th Avenue and Tyler Street are fully <br />developed to City standards, having adequate paving, curb and gutters, setback sidewalks with <br />street trees and street lights. <br /> <br />Van Buren Alley does not have adequate right-of-way width and is not designed to City <br />standards. In order to comply with EC 9.6505(3), the following condition is warranted: <br /> <br />1. The applicant shall submit an Irrevocable Petition for public improvements for Van <br />Buren Alley to include paving and storm drainage. <br /> <br />Irrevocable petitions enable the City to initiate a local improvement process and obligate the <br />property owners to pay their proportional share of the street construction costs in the future. <br />The City could construct the street/alley when the majority of benefitting property owners <br />agrees to pay for the improvements. <br /> <br />Based on these findings, no further improvements to the street, alley, or sidewalks are <br />proposed or required at this time. <br /> <br />5) Bicycle Paths and Accessways <br /> <br />No bicycle paths or public accessways are proposed or required. <br /> <br />Based on the above findings, the proposed middle housing land division will comply with these <br />standards. <br /> <br />
