March 2025 Findings & Decision: West 20th Avenue (MHT 24-29) 3 <br />listed criteria. Those criteria are provided below (in bold) with respective findings that address <br />compliance. <br /> <br />EC 9.8194 Middle Housing Land Division, Tentative Plan Approval Criteria. <br /> <br />The planning director shall approve, conditionally approve, or deny the middle housing land <br />division tentative plan application based on compliance with the following criteria: <br /> <br />(1) If the property to be divided is not yet developed with middle housing: <br /> <br />This criterion is not applicable as the subject property is already developed with middle <br />housing. <br /> <br />(2) If the property to be divided is developed with middle housing: <br /> <br />(a) The middle housing complies with EC 9.5550; or <br /> <br />(b) The certificate of occupancy for the middle housing was issued before June 30, <br />2022, and the middle housing complied with applicable land use requirements at the <br />time the certificate of occupancy was issued. <br /> <br />This criterion is applicable because the subject property is developed with an attached duplex, <br />which is a type of middle housing. Based on County records the attached Duplex was <br />constructed in 1958 (effective 1990). Per EC 9.5550(2), that standards at EC 9.5550 apply to all <br />middle housing, except duplexes. As the property is developed with a duplex, it complies with <br />EC 9.5550 under which it is exempt from said standards. <br /> <br />Based on these findings, this criterion is met. <br /> <br />(3) The proposed middle housing land division complies with all of the following: <br /> <br />(a) EC 9.2777, Middle Housing Lot standards; <br /> <br />The proposed Middle Housing Lots meet the Middle Housing Lot standards, in that each <br />proposed Middle Housing Lot contains an individual middle housing dwelling unit. As stated on <br />the proposed site plan, the Middle Housing Lot proposal may not be further divided. Therefore, <br />these standards are met. <br /> <br />(b) EC 9.6505, Improvements, Specifications for any street frontage improvements <br />required for middle housing lots that abut a street; <br /> <br />(1) Water <br /> <br />Water service is available at the site and each unit is currently connected to the public system. <br />Comments from the Eugene Water and Electric Board (EWEB) can be seen in Attachment A. <br />
