March 2025 Findings & Decision: West 20th Avenue (MHT 24-29) 2 <br /> <br />A note on terminology: Eugene Code Section 9.0500 defines a “Middle Housing Lot” as “A lot or <br />parcel created through a middle housing land division”. A Middle Housing Land Division is the <br />only codified process to create Middle Housing Lots. However, for platting purposes, two <br />different terms are used, which are “lot” and “parcel”. The term “lot” is used when units of land <br />are created through the Subdivision process, which creates 4 or more units of land. The term <br />“parcel” is used when units of land are created through the Partition process, which creates 3 <br />or fewer units of land. <br /> <br />In this case, the applicant is creating two Middle Housing Lots, but for platting purposes, the <br />units of land will be referred to as “parcels” on the final plat. For consistency throughout this <br />decision, the term “Middle Housing Lot” is synonymous with “Middle Housing Parcel” and <br />either may be used in the context of this decision. <br /> <br />Public Notice and Referrals <br />Public notice of this tentative Middle Housing Land Division application was provided in <br />accordance with Eugene Code (EC) requirements on January 27, 2025. No public comments <br />were received. <br /> <br />Referral comments were also provided by various City staff and other service providers. These <br />comments are incorporated into the following evaluation with respect to applicable approval <br />standards and are included in the application file for reference. Additional information items <br />are also attached to the end of this decision for the applicant’s benefit. <br /> <br />Applicable Code & State Statutes <br />This application was submitted on December 27, 2024, at which time, the Oregon Revised <br />Statues (ORS) 92.031 and the procedures at ORS 197.365-197.380 applied as discussed below. <br /> <br />The Oregon Land Use Board of Appeals (LUBA) remanded Eugene’s Middle Housing Ordinance. <br />As such, Eugene’s Middle Housing Ordinance was not in effect as of that date this application <br />was submitted. Eugene’s Middle Housing Ordinance went back into effect on January 2, 2025. <br />The application was deemed complete on January 17, 2025, when the City of Eugene’s Middle <br />Housing Ordinance was back in effect. <br /> <br />Therefore, the following evaluation is in accordance with Eugene’s adopted Middle Housing <br />rules instead of ORS 92.031. <br /> <br />Evaluation <br />This request is subject to the Expedited Land Division/Middle Housing Land Division application <br />procedures, which are primarily addressed starting at Eugene Code (EC) 9.7900. The following <br />evaluation also addresses details of the proposal in the context of compliance with the <br />applicable approval criteria and related standards. <br /> <br />In accordance with EC 9.8194, the Planning Director shall approve, conditionally approve, or <br />deny the tentative Middle Housing Land Division application based on compliance with the
